Process for Foreign Spouse moving from Dependents to Work Visa

Featured Replies

Would welcome insights on this process.

Context:

- Both of us our foreigners

- Moved to Thailand for my Work (I have a Non-Imm B)

- Wife is Non-Immigrant O (Dependent of Non-Imm B holder)

- Wife now has a Job Offer with a company that will supply a Work Visa (no further details at this stage)

What would be the process to obtain the correct permits?

Would she have to obtain from an embassy overseas & re-enter & if so, how long does this process take?

Greatly appreciate any insights & advice - thank you in advance!

I am doubtful the wife has ANY valid visa and more likely she's on a matching "extension of stay" based on being the spouse of a foreigner legally employed here which she got from an initial Non-O visa

She would go to the immigration office that issued the extension of stay based on trailing spouse, cancel it, exit the country,

Then she'd either get the Non-B visa from a thai consulate while she's out of the country
OR
come back in free stamp (if she's from a country that gets in 60 day free entry) then apply for the Non-B visa inside the country <- also if the employer can provide the documentation to get the Non-B issued inside the country at the immigration office.

Many employers can't meet the more stringent documentation requirements to get the Non-B's issued inside the country <- that's why they send them to thai consulates in nearby countries because the requirements are less

As far as how long it takes to get the Non-B issued at a thai consulate in another country that is consulate specific, Now that all thai consulates are on the eVisa online web-portal, she would go to another country, apply for the Non-B online with the documentation given her by the employer, wait in that country until the visa is approved.

MOST consulates in 'standard visas' (Non-O, Non-B, Non-ED) are about 3-10 business days in processing <- dependent on whether you upload all the required documentation when you apply or you get a request for additional documentation (which stretches out the processing time

Thank you. That's useful.

A follow up question see a request for Financial evidence: an amount of no less than 30,000 THB (e.g., bank statements for the last three months, sponsor letter).

Can I just transfer THB30,000+ into her Thai account and give 3 months statements or is a consistent above THB30,000 bank balance across 3 statements required?

You're talking about applying for the Non-B online thru a thai consulate in another country and although I could be wrong I believe they require 3 months of statements but that the 30K required funds only needs to be in the account the day you apply (not the previous 3 months)
