Vietnam has introduced a new decree outlining community-based diversion strategies for minors, aged 14 to under 16, who commit offenses. The decree specifies the use of electronic monitoring and reintegration support, taking effect January 1, with electronic monitoring provisions active from 2028. This initiative aims to provide structured rehabilitation for young offenders and support their reintegration into society.

The decree, consisting of six chapters and 27 articles, elaborates on the Law on Justice for Minors. It includes several diversion measures, such as educational and vocational training programs, psychological counseling, and community-based procedures. Electronic monitoring will be restricted to the juvenile's commune-level administrative area, ensuring close supervision without impeding daily activities.

Electronic monitoring devices, attached to the minor or their belongings, will track movements without interfering with personal activities. Decisions for monitoring are made by the commune-level People’s Committee, with local police assigned to supervise the juvenile. A detailed handover process is required, and working sessions with the juvenile are mandated.

If a minor violates the monitoring terms, local police will prepare a report for the commune-level chairperson, who will escalate the matter for appropriate action. The monitoring process mandates timely notifications prior to expiration, and any breaches, such as unauthorized area exits or device tampering, must be reported, with possible penalties for damages.

Looking forward, the decree stands to enhance Vietnam’s juvenile justice framework. By introducing electronic monitoring, Vietnam seeks to balance accountability with rehabilitation.
