Hi guys, sorry if this has been covered,

but I did a search and didn't get very far.

Wife and I married in the UK 03/2007

She has LLR visa expires 03/2009

Her Thai passport expires 01/2009

We have been living in Thailand this year, with 6 weeks in the UK in the 'summer!'

What do we need to do to get her LLR advanced to a FLR or ILR?

As a basic requirement for indefinite leave, your wife will need to pass either an ESOL with Citizenship course or the Life in the UK test. Additionally, she will need to show that you have been living together for the 2 years preceding her application, and that there remains adequate maintenance and accommodation for both of you. The length of time your wife has spent outside of the UK may also be a factor in the decision as the UK Border Agency may conclude that she is not settled in the UK. Failing qualification for indefinite leave, your wife may also apply for an extension to her current status. Either application should be made shortly before the current permission expires.

Can she apply from inside Thailand, via the embassy or consulate, or do we need to be in the UK?

You need to be within the UK.

If your wife is in Thailand when her settlement visa is about to expire, she will have to start the process again and apply for a new settlement visa from the embassy in Bangkok.
