i was fired from my work (very unclear reasons - but that's another story). since my employer told me the news they said they would renew the work permit for me, and they honored their contract by deciding to pay me for the remaining time on my contract. things haven't worked out too badly so far. i have two weeks left at this place.

yesterday i asked them about the work visa and they told me this. basically the work permit will run out at the end of the month, along with the contract. if i find a new job in that time they will transfer it to a new employer, meaning that i won't have to do the border run. i was under the impression that at the end of the contract i would be given the work permit, which would be valid for some time after finishing the contract. it seems like i have to find a new job by the end of the month, or leave the country. is this right?

i understand that this may be the law, but could they technically just give me the work permit (let's say, out of their good will), allowing me more time in the country to look for work? also, are there exemptions for having a work permit if i am working on a freelance basis?

If you are on extension of stay, as soon as the job goes, your suppose to be out the country too...you can pay for a 7 day extension to remain in country. The work permit is tied to the company so once you leave the WP goes as well.

Some employers if everybody parts on good terms will keep a WP running until the person has left finds a new job and transfer the WP to the new company.

Some employers if everybody parts on good terms will keep a WP running until the person has left finds a new job and transfer the WP to the new company.

Bearing in mind you may have to pay your own taxes/national insurance to the company,to keep everything legal when you transfer the WP, not sure what set up you have going.

assuming i don't get a job in the next two weeks, i would then have to go the the border somewhere and get a new visa, right? in this senario, what type visa should i be applying for? a regular tourist visa? 30 or 90 days? is it possible to get 90 days at the border?

If you only go to the border and come back you would get 30 days, (if you qualify for visa exempt entry).

If you go to a neighbouring country you can apply for a tourist visa, with luck even a double entry tourist visa. A tourist visa would give you entry for 60 days, which can be extended for 30 days by paying 1900 baht at an immigration office.

I don't know your nationality, so I can't be sure about the period you would be allowed to stay.

my new work place said that the day my old employer hands back my work visa i have 7 days to lodge an application for extension (for another 10 days), or leave the country to get the tourist visa.

can anyone confirm this?

i'm australian - don't know if that makes any difference as to what tourist visa length i'm eligible for.

No longer the case; if you are on an Extension of Permission to Stay based on business, then you visa is cancelled when your work permit is cancelled.

Your previous posts have not made it clear if you get a passport stamp by going to the border or from your local immigration.

If you are not getting your stamp from your local immigration then your visa is not tied in any way to your current work permit and you can stay untill your stamp is up, if you have a stamp from your local immigration then you must immediately leave the country to get a new visa/stamp (or you can get a 7 day extension).

how can i tell?

i got a non-immigrant b visa from neighbouring country back in may. worked for six months in bkk, and went to the imm. office with secretary from work every couple of months.

the last stamp in my passport says i have an extension of stay until 20 aug 2009. i'm not sure where this was stamped.

You are on an extension of stay, meaning your permission to stay ends the same day your job ends. You have to go to immigration with a letter from your employer stating your job has ended and they will cancel your visa. You can get a 7 day extention at a cost of 1,900 baht.

even if this information is computerised (it doesn't seem that sophisticated), what's stopping me from not reporting my work visa termination at the imm. dept., and only going to do a border run when i get a new job in a few weeks time? eg. if i turned-up at the border with my current passport in a few weeks time, with my non-imm. b stamp expiration date as aug 2009, then who is to know that my work permit has expired in bkk?

just trying to understand how things work here you understand, not that i will try anything that will put me in at any risk.

I recall seeing a post where a member turned in his work permit and then went to immigration and by the time he got there the labour department had already sent a fax to immigration.

It is no longer required to hand in the WP. How would immigration now? Well, your employer might send them a fax. Also when you apply for a new WP and permission to stay the Labour department and/or imigration might ask about your old job and might want to know when your old job was terminated and require some proof of this. i did ask, but they've been a serious pain in the a. when answering this simple question. they initially agreed to give it to me, then when i asked on the last day they said they'd delay surrendering the w/p for one week. i asked what i needed to do through another intermediary (work colleague), and i got a different answer - we will hand back your permit next week. it's their sad way of reliquishing power (face), as i leave for a much better job. pathetic, but i didn't react. will go into the office next week and see if anything has changed.

i hate this thai visa/work permit bulls&*t.

Hi,

my situation is a little bit different, but I need some advise too.

My contract ends on Dec. 31, 2008. I already signed a new contract with a new company, starting Jan 1, 2009.

My current WP and Visa just have been extended to Oct. 31, 2010.

- When my current contract ends on Dec. 31, normally my visa is cancelled

- Can the WP be transferred to the new company?

- I want to avoid any visa run, because I simply have no time to do it

Any ideas to get around this? I appreciate your help.

You could ask your old employer if he agrees to have the new employer added to your WP, (if both employers are in the area of the same labour office). Ask your old employer to hire you for a bit longer and give you an unpaid leave, during the leave you start wotking for the new employer and after a month or so your old employer terminates your contract. Your WP and permission to stay will then remain valid.

Your WP can otherwise not be transfered to the new employer and you would have to apply again for both WP and Visa.
