Travel For Newly Married Thai Girl

Featured Replies

Ok, here is the situation.

Thai girl is here on F1 Student visa. Student visa is now expired but she is married now to her boyfriend who is another Thai who is a Permanent Resident. She's been married for just over 2 months.

She wants to travel back to Thailand but since her student visa is expired, it looks like she has to re-enroll into school so that her student I20 status will be valid.

So the question is, if she travels back to Thailand, will she be allowed to come back to the US because she is married? Or does she have to wait for the entire immigrant visa status to finish?

Please advise and TIA!

No comments as yet? And from your terminology, I bet in the U.S., right?

First Q, has her Thai husband (not "boyfriend") already applied for an "adjustment of status" to PRA for her?

This becomes a bit complicated and CIS (formerly INS) rules might call for her to return to Thailand to wait out the period for a visa number to come up, which could well be 2-3 years, or more.

I'm not up on current U.S. Immigration law so suggest you wander around the CIS www site a bit: http://www.uscis.gov/portal/site/uscis
