Hi,

I'll just state the facts here and ask for someone to please confirm if I'm on the right track or otherwise;

I have 30 days left on a tourist visa.

My wife is a teacher here and has a work permit.

My two children go to school here.

I spoke to the people at the school where my wife works and they have told me that I can go to Bangkok - (they say I don't have to leave the country, which sort of goes against what I've read so far) - and in Bangkok I can apply for a non immigrant '0' based on the fact that my wife has a work visa.

I have to have 21 days left on my visa - which means I need to get this done quick smart.

They also told me that I'll only need to show them my marriage certificate and my wife's passport.

Going by my previous experiences with Thai immigration, this all sounds a little bit too easy to me and I'd appreciate the input of anyone who has any experience with this particular type of visa application.

From all reports I have seen and the immigration website it is not possicle to do a change of visa status to get a dependent extension of stay.

Also unless you live in Bangkok they will send you back to your assinged office.

The best option you have is to go to a nearby consulate and get a single entry non-o visa to visit family. You will need a copy of your marriage certificate and a copy of of your wifes passport showing her visa and estension of stay. Or if your children are on an extension of stay you could use their birth certificates and extension of stays.

Then within the last 30 days of your permit to stay apply for the extension.

My wife has a dependants visa based on my WP.

I suppose TIT so a husband cannot get a dependant visa on wifes WP?

I am afraid I dont know, anyone?

A Wife can get a 12 month extension of stay based on her husbands 12 month extension of stay.

Believe below is what would normally be used - but also believe the required paperwork is seldom available.

DOCUMENTS TO BE SUBMITTED IN SUPPORT OF THE APPLICATION FOR VISA OR VISA STATUS ALTERATION (NON-O): FOR SPOUSE, CHILDREN, PARENTS OF FOREIGN TEACHER IN THAILAND

In case of overstaying in Thailand, application could not be submitted.

Application for Visa Status Alteration. (TM.86)

Application for visa. (TM.87)

Copy to passport entries.

4 X 6 cm. Photograph.

Application fee of 2,000 baht.

5.1 Documents proving that the applicant is the spouse, father or mother or child of foreigner ; a marriage certificate or birth certificate, as the case may be. (Certifying by Embassy or Consulate and Ministry of Foreign Affairs.) Or

5.2 Letter from a government office, embassy or consulate, Certifying that the applicant is of the referred family, Or

5.3 a guarantor-letter from The Department of Protocol, Ministry of Foreign Affairs. Passport and work permit.

Passport and work permit of related teacher.

A certified letter from school proving that related teacher applicant is working in that school.

A certified copy of Registration papers of the educational institution. (Certified by authority signature and institute seal)

A certified copy of the license of the school or university administrator. (Certified by authority signature and institute seal)

List of personal income tax of alien employee (Phor ngo dor 91) for the last year.

Joe. I am not sure but does this refer to the question? From Immigration Website. Sometimes their terms are a bit difficult to understand.

The last one that I remember may of been for a dependent on a retirement extension. So my brain cells might of crossed them up.

But if they are telling him to go to Bangkok that may mean the local office won't do it. Similar to Phuket not doing it for marriage to aThai.

The OP appears to be in Chiang Mai. I remember reports in the past from there saying that they will not change Visas for any reason. So it looks like he will have to get a Non Imm O Visa from a Consulate. Probably Vientienne.

Thanks Lite Beer - I neglected to mention I'm in Chiang Mai - it's looking more and more like I'll be going out of the country for this one - although the school tell me they phoned immigration and immigration have said Bangkok's fine :)

What Immigration Office did they phone? They would be better off phoning Bangkok.

Chiang Mai should really be providing this service.

If you do have to go to Vientienne it is not so bad and only has to be once.

From Chiang Mai KL is a good choice to get a single non-o also. You can buy your tickets a couple of weeks ahead of time on Air Asia for about 4600 baht round trip.
