Hi everyone,

Following the very cold feeling in the pit of my stomach on the refusal of my extension of stay yesterday, today has ultimately ended on a high note.

I made the proposed visit to Chaeng Wattana and explained to the Immigration Officer there that I wished to appeal the decision made by the Samut Prakhan office. He checked my documents, checked through the rules himself, asked a colleague behind him for confirmation, and then came back and asked if I had the telephone number for the Samut Prakhan office.

He called and explained that they were in error, then told me to go back and report to a specific person, Captain Tannahcheagh(?). When I arrived back at Samut Prakhan, I was immediately waved to the boss's desk who said "I am so sorry!" I received my one-year extension within about three minutes, with the receipt for yesterday's one week extension being used; thus, no need for additional fees!

He apologised again and advised me that all of the staff at the Samut Prakhan office have now been advised of the correct rules to avoid any similar situations in the future. So, hats off to Captain Tannahcheagh for his acceptance of this learning event, and I would suggest that anyone visiting this particular office will not be required to deal with this issue in the future.

That's excellent. Its an object lesson that at least sometimes you can question authority here (when you are sure you are correct by the Thai rules) without being crushed.

I am glad to see my general opnion of the S.P. Imm office confirmed. Mistakes happen but they have always been VERY friendly to me and have been quite professional in my dealings with them.

I am hoping that the CNX office lives up to its reputation. I will know next week I think :)

This is one of the more up beat posts concerning visas. :D

It has been disconcerting to read the individual interpretation of visa rules some outlying immigration offices apply when dealing with foreigners. :)

It is good to see that by simple perseverance and by going to the right person erroneous decisions can and are rectified.

They said that his bank balance had not been at that level for 3 months.

In the rules there is no such requirement when using Income and bank deposit when applying for a 12 month extension.

I'd like to get a copy of that ruling as Phuket Immigration still enforces the 3 month requirement, in error as represented here? :)

Basically, you can show monthly income of say 20,000 baht (presumably you will need this minimum amount to live) plus you can contractually borrow the balance (in this example 560,000 baht) for a few days, then repay it.

If this is correct, then ex-pats should set up a legal fund for this purpose, thus releasing their own money for other more enjoyable uses. For example, 20 people would risk 28,000 each (just over one month's income) in case of default.

Worth the risk?

The experience of GeorgeO reported in the first post of this topic proves that there is a way to appeal a wrong decision by an immigration office and that this appeal process works.
