Uk Settlement Waiting

You are not quite right.

A spouse settlement visa is valid for 27 months, and can be first used at any time up to and including it's expiry date.

However, the next stage after the initial spouse visa is Indefinite Leave to Remain, and to be time qualified for this one must have been resident in the UK for at least 24 months. Therefore, if one delays one's first entry to the UK with a spouse visa for more than 3 months then it will expire before one meets the residential requirement for ILR. However, one can make an in UK application, known as Further Leave to Remain, to cover the gap.

At current rates, the fee for FLR (£500) is cheaper than that for a settlement application (£750)

Thank you for that, I clearly had not understood previously. The two year residency rule is not a concern since my partner and I have been together in a relationship in Thailand for more than four years hence she is capable of applying for ILR (subject to KOL) without having to wait.

But one further question, my partners TB certificate expired on 20 December, will she require a new one before she can travel to the UK on her current ILE visa?

Even though she has ILE subject to KOL, the visa will have an expiry date. She needs to 'activate' it by first entering the UK before this date.

She will then need to satisfy KOL and apply for ILR before the expiry date, otherwise she will have to apply for FLR when it expires and then ILR once she has satisfied KOL. She can apply for ILR immediately she has satisfied KOL without waiting for her current visa/leave to remain to expire.

As long as her TB certificate was valid when she applied (which it must have been otherwise the application would have been refused) then that is ok, it shouldn't matter that it has now expired before entering the UK.

Just a note as people appear to be monitoring waiting times. My wife applied on or about 18th of November. Decision was made on 23nd of December. Arrived by courier in chiang mai on 27th of December. Merry Christmas!

Few notes, can give more details if you like. I'm 27, my wife is 29 and an accountant. We met last year, i had to go home then came back and we lived together in chiang mai for 9 months. Went back to the UK to find work about two weeks after making the application. My parents agreed to support my wife and as well as lots of photo, the lease of our house, all the standard marriage certificate and other official docs etc we included evidence of my parents owning their house and being fairly comfortable financially etc. Me being unemployed apparently didn't matter. If anyone in a similar sitiuation wants more details/reassurance etc (i know i wanted it) feel free to post a reply or send me a message

I just like to say that I think this is fantastic to see, good luck to all. I'm still in the early days of sorting my GF things out, reading the form and getting ideas, my GF is here on her first 6 month Holiday Visa, when she goes back to BKK at the end of it, and when I feel the paperwork is ready we will go for the Fiancee Visa.

Hi btw. I am new to posting here but have been lurking here a few years. It was the very good information posted here that has allowed my girlfriend on now my wife to visit the uk on her visit visas over the past 2 years.

Only one in the list... thats unacceptable. But maybe it's a good sign :). The missus did say the queue was very small! Perhaps it's the effect of the new test.

We married on December 22nd and we submitted the settlement visa application on the 11th Jan 2011. I did the visa application like the previous 2 based on everything I found here and we did the test in the UK the same week providers here starting offering them.

I miss her so much the past couple of weeks and I am deseperately hoping I am not on those those who have o wait 8 weeks on longer or worse those that get rejected. I cannot imagine how much that hurts....

We have our visa for Baby Gate ;-) applied on the 16th Dec received 14th Jan not to bad!

Seems a distant memory from being sat in regents house pulling my hair out ;-)

Just wanted to say well done to all those who have been successful and those who haven't don't give up.

We got ours way back in October after about 14 week wait I seem to recall. Good to see the waiting times have come down a lot. 4 weeks is superb. What's the reason for this less volume of applications or more staff I wonder?

I just collected my 3 month visa for THAILAND today. We're returning for a long holiday next month - can't wait.

Less volume is more likely; not necessarily for settlement visas but other types as well. The waiting time always seems to increase from around March onwards each year and then start to drop around October, November.

Glad to see all the visas being accepted and that the waiting times have come down even more :rolleyes: .

Question for 7by7 (sorry, yet another one):

As you may remember, my wife got her settlement visa and we came back to the UK in November. As we have been married/living together for more than 4 years, I wrote a covering letter to go with her application requesting ILR (subject to passing KOL test), but surprise, surpise she was stamped with the regular spouse visa.

When we got back to the UK, I sent my wife's passport together with a letter explaining the mistake made and details of the correct endorsement.

Fortunately I sent her passport by recorded delivery, and I phoned them to confirm that the passport has been received, which it has, (RCU EC Errors, 15th Floor Apollo House, 36 Wellesley Road, Croydon. CR9 3RR).

I guess that the passort has been sent to the British Embassy in Bangkok, but I have had no email or written confirmation of receipt, and we have heard nothing else nor got the passport back. Question is: Should we be concerned about this, or should we just wait for however long it takes and not worry? It was posted on 8th December, so it's been nearly 2 months now.

I'm not unduly concerned, but it does seem wrong that she has been left in limbo this long.

On a separate note, is it just me, or do other people feel that employees for UK Border Patrol are somewhat OTT, and sometimes on a power mission?

When we came back to the UK and submitted our passports, I couldn't believe the cheek of the bloke checking them who said to me "It's a good job that your wife came on a settlement visa this time"..... "Why?" I asked...... "Because she might have had problems if she'd tried to come to England for a 3rd time on a tourist visa", he replied.

"We've been married 5 years and have a child together, so she ought to be able to come to the UK on a tourist visa as often as she ******* likes", I thought, but held my tongue. Also, she DOES have a spouse visa, so what's YOUR POINT???

It's like saying that if Geoff Hurst's goal which 'crossed the line' had been disallowed by the referee, then England might not have won the World Cup in 1966. Fact of the matter is the referee did allow the goal and England did win the World Cup, much like my missus was issued a spouse visa and she is allowed to settle in the UK. As Alan Partridge would say, "KISS MY FACE!!!"

I hope that my missus's passport comes back soon, because otherwise if somebody calls the Home Office and claims that she's an illegal immigrant, I may well have the powers-that-be coming round to my house and kicking my front door in. And if I my missus can't show her passport, she could be immediately deported!! (anyone seen UK Border Patrol on Sky??)
