When my Thai girlfriend applied for a Schengen visa at the German embassy last wednesday, they told her, she could pick up the visa on friday. On friday they gave her a letter, saying that the visa is refused due to the German laws on foreigners. They didn't give any reason. I think, this is very strange. Has anybody got an idea what the reason for that could be? The visa agency in BKK said, everything was ok with the papers. Does the embassy normally involve the thai authorities, so they may have found out something that I don't know?

In UK immigration law the concept of a breach of public faith exists. What this means is that if the visa officer, aware of all the facts, states that a visa will be issued, then it must be issued. I don't know if the same exists in German law, but you could try phoning the embassy, asking why one day they were going to grant the visa and the next it was refused. Also ask the specific reasons why and you can then prepare your case should you choose to take the matter further. I believe, also, that each Land has an Auslaenderamt (sp?). Perhaps you could ask there for some guidance.

this sounds indeed strange as my experience with the german embassy is that most of the rejection happen right at the day of application when checking papers, interview etc.

of course it could be they checked her criminal file in LOS meanwhile & found something not to their taste?

for schengen visas I'm not sure the german foreign offices can help much as the embassies in each country are suposed to handle those on their own?

I had my TGF schengen visa in the usual 2 days & now after some 3 weeks it seems we 'almost'? have our family visa based on marriage as well :o

p.s. I'm non german/EU citizen
