Jatuporn, other MPs endorsed

The Election Commission yesterday endorsed red-shirt leader Jatuporn Promphan as a Pheu Thai party-list MP despite doubts over his qualification to be a Member of Parliament.

The Election Commissioners voted 4-1 in favour of endorsing Jatuporn, whose "victory" was suspended previously due to questions over whether he was qualified to contest the July 3 general election.

Jatuporn was detained after a court order and failed to cast a ballot on the election day, which led to questions about his qualification.

A source said it was likely the EC would suggest that Jatuporn's case be sent to the Constitution Court for interpretation of related provisions in the charter.

The EC also endorsed three other MPs-elect, whose victory was suspended earlier due to suspicion of electoral fraud. Now, all 500 MPs have been endorsed by the election agency.

Of the three MPs-elect suspended earlier, a Pheu Thai MP and a Bhum Jai Thai MP respectively won Sunday's second round of voting in Nong Khai and Sukhothai, and the third - a Democrat MP - was declared the winner in a ballot recount in Yala.

Earlier yesterday, Dr Tul Sitthisomwong, coordinator of the Network of Citizens Protecting the Land, petitioned the EC against endorsing Jatuporn as a Pheu Thai party-list MP. The petition, addressed to EC chairman Apichart Sukhagganond, was accepted by a senior official of the election body.

Tul threatened to take legal action against the Election Commissioners if they decided to endorse Jatuporn despite doubts over his status.

The activist said Jatuporn should be regarded as losing his party membership since he was detained under a court order when registration of the election candidacy opened in May.

He said Pheu Thai leader Yongyuth Wichaidit and secretary-general Jarupong Ruangsuwan had made false statements to the authorities while testifying before the EC that Jatuporn was still a party member. Tul said the goal was for Jatuporn to get EC endorsement so he would get immunity from detention during the parliamentary session.

Jatuporn has been held at Bangkok Remand Prison on a charge of terrorism, connected to rioting by red shirts in the city centre last year.

Election Commission Endorses Red-shirt MP-elect

Election Commissioners have endorsed the MP status of red-shirt leader and Pheu Thai Party MP-elect Jatuporn Phromphan, with a four-to-one vote, prompting an attempt to seek his release on bail.

Election Commissioners voted four-to-one to endorse the MP status of core red-shirt leader and Pheu Thai Party MP-elect Jatuporn Phromphan.

The only thumbs down came from Election Commission Chairman Apichart Sukhakkanont, who had also previously voted against endorsing the red-shirt MP.

Prior to the endorsement, Pheu Thai party-list MP Nuttawut Saikuea said he will seek the release of Jatuporn, who is currently jailed on alleged terrorism charges, should the panel certify his MP status.

When asked about his idea of restoring national unity, Nuttawut said he is willing to work with all sides, since he has been actively involved in the long-standing political conflict.

He added that not everyone has to think about unity.

Thai people can still live peacefully together.

As to whether the red-shirt group will cease its political activities, Nuttawut said red-shirt supporters will remain active, but have yet to figure out their next move as it is not yet known where the country is heading.

This is brilliant - Now with immunity while parliament is in session Japtuporn and co can as MPs make the laws for us mere mortals to follow, yet these laws don't apply to them. Now there is a classic double standard.

The old adage, 'do as I say, not as I do', springs to mind.

The first motion of Parliament should be to revoke the immunity part of being an MP - otherwise how can we, the people be expected to respect the law if our MPs don't and have a free hand to do what they want with impunity.

No wonder so many alleged criminals are turning up as MPs . Maybe it's possible to convince one of them to ahem, remove, Jatuporn permanently. After all they have immunity and needn't fear jail time.

No wonder so many alleged criminals are turning up as MPs . Maybe it's possible to convince one of them to ahem, remove, Jatuporn permanently. After all they have immunity and needn't fear jail time.

If I anot mistaken he was arrested for an LM charge. So have many others under the exiting government. Abuse of the law to me. I for one am happy he has been released, he reminds me of those great politicians ranting from the hustings, like Tony Benn and Michael Heseltine. When you had the dems complaining about being heckled whilst campaigning the real politicitions would have taken them on in there own den. To do that you have to believe in whatyour saying, unfortunately most politicans here dont have belief. Jatuporn could take on many if not all other politicians in a debate and beat them hands down. Good luck mate they love you on Thaivisa

This is why, although unfortunate and unsavoury, the military needs to be in overall control.

You are mistaken he was arrested for violating bail conditions related to the charge of unrest and violence during last years riots. I agree it would be nice to have more politicians who felt as passionate as Tony Benn in Thai politics, rather than continuing the family dynasty. But, I have to say I don't think Jatuporns passion is based on a political ideology, given the 10Million baht allegedly transferred into his bank account during last years riots. He's more of an opportunist.

Election Commissioner: Jatuporn's Endorsement Was Lawful

An Election Commissioner insists Jatuporn was endorsed in accordance with electoral rules and regulations.

She is challenging the public sector to file a lawsuit against her for alleged wrongdoing.

Sodsri Sattayathama, one of five Election Commissioners, said anyone has the right to file a lawsuit against the Election Commissioner it is believed the commission has carried out its duties wrongfully in endorsing MP-elects in the July 3 general election.

However, the election commissioner vows to file a counter-lawsuit if the allegations are ruled false.

Sodsri claims her decision to vote to endorse red-shirt leader and Pheu Thai MP-elect Jatuporn Prompan was in accordance with the law.

Even after Jatuporn is endorsed, the Constitutional Court will be asked to rule on the endorsement at a later date.

She said the Election Commission took a lot of time to consider Jatuporn's endorsement, which involved scrutiny by various sub-committees.

Sodsri said she does not want to become notorious for making up stories that she has been threatened.

The election commissioner said that if something were to happen to her soon, it will likely be because of this issue.

When arrested after the 2010 riots, he was already out on bail for charges relating to the UDD attack on the ASEAN summit during the 2009 protests.

The speech he gave during a recent UDD rally in which he made veiled references that many, including Chavalit, who resigned from the PTP because of it, considered LM. Because of that his bail was revoked.
