Hello,

37-year-old American here. My Thai partner and I have a 4-year-old son together. We're finally legalizing our marriage soon. Once we're legally married, I understand that we split legal custody of our son 50/50. Prior to that his Mom technically has sole custody under Thai law.

After we are legally married, do the amphurs issue any document (besides the marriage certificate) that states custody is split between both of us?

Going to raise our son in America, and I imagine at some point (school registration possibly) I may need to furnish a document that states his Mom and I have 50/50 custoday and both have "parental power" or "guardanship". Would our marriage certificate suffice or is there a Thai "tor ror" doc that I should also look into obtaining and translating to English?

Any thoughts appreciated!

Thanks,

Scott

Provided you are named on the birth certificate, you will automatically have shared parental rights with the mother. They may make a note on the weddingregister entry regarding that, I'm not sure.

The amphur has a document stating that someone has sole custody (Khor rhor 13), so I presume they will also have a document stating that a person has shared custody with somebody else.

Normally the birth certificate (and wedding certificate) should be enough to proof you have shared custody. I presume your son has a US-passport, and thus is probably already legitimized by you under US law as he gets it's citizenship from being a decendent of you.
