Criminal Court Orders Extradition Of Two Thais To Face Murder Trial In Australia

the third person is listed as 28 year old Teparat Tepsut but the police do not have a photo of him!

These two photographs were taken when they were arrested for a serious assault (stabbing) not thier 1st arrest either in Melbourne. You see the two numbers on the right handside of the photo sheet? The top number is the master name index (MNI), no big deal as everyone who has anything to do with the police is assigned this, witnesses etc, just a reference number. The bottom number is the criminal reference number (CRN) this indicates that they already have a criminal record in the State of Victoria, Australia prior to this arrest. As I said they were already well known to Victoria police and had a history. Had the courts and immigration department taken steps and deported them when they 1st broke the law then this whole sorry incident in Brunswick would not have happened. They were allowed to stay in Australia and continue thier criminal activities. Drugs, serious assaults and standover tatics. Not the good little boy that mummy in Thailand claims her son was.

I hope the Australian public have asked questions of their judiciary and courts on how these criminals were allowed to be released and immigration the reasons why they were not deported.

The Uk has this crazy pathetic European court B***s**t where a convicted criminal can avoid deportation on "Human rights grounds" and then string out any deportation ruling in the courts at tax payers expense, One of the reasons I lost all respect for British Law now subverted by European dictat

Australia is the same, just claim that if you were forced to go back your life would be in danger. I wouldn't be suprised if these two fine upstanding Thai gentlemen had a few enemies in Thailand who would wish them harm. Oh sorry Surad's mother says her little boy is an angel and has never fallen foul of the law. Yes in Australia you can drag deportation issues out for years/decades and freely roam the streets doing as you please.

What they deserve is a fair trial. Ever hear of an innocent man (or men, as it could be in this case?) being accused of a crime? I think it's actually fairly commonplace, and to jump to conclusions is not really fair.

Let's not forget the witnesses to both incidents including the wife and sister in law who were close enough to the incident to be slashed trying to stop the attack. The facefits they and other independant witnesses compiled prior to viewing a photo board identifying these two. Facefit, photoboard and CCTV all matching the defendants. What about the witnesses who all obatined the same vehicle registration number of the vehicle the defendants used. The defendants DNA located in the vehicle at the airport along with the victims DNA in blood located in the vehicle. Just to name a few pieces of evidence all very damning for the defendants. Yes they are innicent until proven guilty and the fat lady is warming up the vocal chords as we speak.

Imagine a Thai lawyer claiming that DNA could be contaminated and the Victorian police are incompetent. Coming from a country that wouldnt know 'a proper evidence search" by a "credible police investigation" and a "fair Trial " if they saw any of those.

Every Dog has its day. The only trouble with them being convicted in OZ, they live a life of luxury in the big house. The Sydney one oddly enough is also called the Long Bay Hilton. But as they will be tried in Victoria, they will do time there. Their prisons would be no different toN.S.W.

Agree fully, in Victoria they will have computers,tv,mobile phones,cigarettes provided free and visitor access plus 3 meals a day.Prisoners in Victorian Jails have more rights and are better off than aged pensioners.

Leave them in Thailand I say.

The Criminal Court Wednesday ordered the extradition of two Thai men to face a murder trial in an Australian court.

The court issued an order for the authorities to extradite Sarat Sihaweerachart, 28, and Thatiya Therdphumtham, 26, to Burnswick, Victoria, Australia, within 90 days.

Aussie man's murder case held up in Thailand

It could be months before a Thai appeals court hands down its verdict on whether two men can be extradited to Australia over the murder of Victorian good Samaritan Luke Mitchell, legal sources say. Surad Seehaverachart, 29, and Thatiya Terdputham, 26, are accused of killing Mr Mitchell in Melbourne in May 2009.

Australian authorities want to try the pair for the murder of Mr Mitchell, who was bashed and stabbed to death while trying to save another man being assaulted outside a nightclub in Brunswick, northern Melbourne.

The alleged killers fled to Thailand just hours after the stabbing. Both men, who were students in Australia, have pleaded not guilty to the murder, saying they had fought in self defence and claim a third man was responsible for the killing.

As for the two Thai soi punks. Leave them to rot in thai prisons. It would cost $60,000 a year to keep those cowards locked up in Melbourne. The only reason they dont want to go back is because they cant pay off the judge.

Did he get into Australia without a passport, surely not...................passports contain up to date photos. Could the Federal police not get a copy from immigration, he would have had to stand in front of that little camera when leaving. What in the hell is going on here ?

If Thailand does not extradite these fellas, Aussie numbers will be down. That is the crux of this case. And obviously these guys are not heavy-hitters in Thailand. If they were from a family with a bit of clout, it would make an interesting situation, as there is a lot of tourism revenue on the line here. Aussies are now the biggest visitors to Phuket, and they still have money in their pockets (even allowing for tightness being a national sport) .... the courts have already made a mockery of the lack of an extradition treaty, I reckon they will be extradited forthwith.
