Hello everybody

I wonder if someone can help me with this issue. I'm an Australian permanent resident married with a Thai lady. My wife is in Thailand now she is going to apply for an offshore spouse visa, my immigration agency in australia told me that it could take from 4 to 8 month for the visa to be granted, and that really pissed me off. They told me that she could apply for an onshore spouse visa but first she have to get a visitor visa to come here, and they told me even if she can get the tourist visa she could get problem anyway to pass the custom at her arrival at airport as the custom officer will suspect she is not a genuine tourist. So now I'm a bit confused to which way to follow, wait long time or try to get here with a risky shortcut. Has anyone gone through this process and give me some advice?

Thank you

Marco

Lets see.....

Are you legally married?

Has she been to Australia before ?

If she comes on a tourist visa with a 8503 (no further stay) condition then she will will not be granted any further visa.

A spouse visa can take from 3-6 months from what I have heard, I would follow the legal channels, if you try and take a short cut and it stuffs up, you could have problems with future applications.

Here is the Immigration Website address, I have had a brief look but you may want to scope it out in more detail.

Thank you for your reply

We are legally married in Italy as I'm an Italian citizen and she has never been to Australia before. I just moved to Perth 2 month ago. As you suggested I think to avoid a no futher stay visa is to follow the legal way and keep waiting. You know is so difficult stay apart from your beloved one when lately married and more difficult it is when you are in another country. Just hope that all things run fast and smoothly.

Bye and thank you again

I would either ring the Immigration or arrange for a visit to discuss the situation, you have some things that are not the normal run of the mill stuff and expert advice is probably your best bet.

good luck
