Statute Of Limitation On Making A Claim For Unpaid Wage

Featured Replies

Is there a Statute of Limitation on making a claim for unpaid wage ?

No idea about statute of limitation, but how long ago did you leave your employment? Was there a contract? Is there a reason why you have waited? Was there any plan or anything in writing about wages owed to you?

Yes, there is a contract and at the time, a work permit. 2 years old... Delayed because Employer keep making promises to pay.

see section 193/33

seems like 5 years on first look

I probably agree with you but someone suggested that it might different if a claim is made thru the Labour Dept.

Probably the best thing to do after 2 years is to file a claim with the Ministry of Labor. After 2 years, I would think the employer has no intention to pay. If it is a significant amount of money, it might be worth having a lawyer make a phone call to the employer.
