Hello there, I'm a thai girl who has a good job and well education in Bangkok. I haven't been to England before. Now I'm going to apply for settlement visa and I have a few questions ...

1. My husband hasn't got a job for a while (about six months) as he has been coming over here many time so he couldn't get a permanent job. Anyway he has about £50k in his bank a/c .. would that help??

2. I read from britishembassy website it says that .. if you wish to apply for settlement visa you are supposed to be the person who has constantly been to UK before. is it true??

3. Also I would like to know that .. is any of you there have got settlement visa for your spouse while you haven't got a job??

Thankyou for reading .. any comment/ help would be really appreciated.

Hi there,

See 13.5 Spouses and how they qualify.

The scouser or GU22 would be able to give you more comprehensive answers to your specfic questions. However, here's the short version.

1. Your husband needs to show that he has sufficient resources for himself and his family members to avoid becoming a burden on public funds. See Chapter 9 – The maintenance and accommodation requirements. Having £50k in his bank a/c would certainly help.

2. I don't think that this is necessary if you are married to a UK citizen/resident.

3. Yes.

Good luck!

Thanks Vinny .. really kind of you for the comment .. eventho I'm still not quite sure about this .. really wanna make it all as much perfect as I can ... Also I would like to know that ...

1. Would it be any effect to apply for the second time ( in case I got refused)??

2. Would it make a big difference if my hubby goes back to get a job .. ( Just wanna make sure what if he doesn't go back we would at least have a chance like 75% to get it so I would wanna take a risk) would be better to fly over there together, wouldn't it :D

any more idea please???

The links provided by Vinny should give you most of the information you require, but to answer your specific questions.

1) The immigration rules say that your husband must be able to support and accommodate you without recourse to public funds (that means not claiming any money from the government). As he has £50K in the bank, and can presumably prove it, then that will be sufficient. It would be a good idea, though, to show what efforts he has made to get a job once he returns to the UK. He should also provide details of where you will be living and whether he owns the property or rents. If he owns it then he should provide proof, e.g. a mortgage statement, if he rents then a copy of his tenancy agreement and, if possible, a letter from his landlord confirming the details and that you can live there.

2) No, not true. Can you say where on the embassy website you saw that, and if possible provide a link?

3) Not personally, but I know of several people in your husband's situation who have successfully got a settlement visa for their partner.

Chok dee.

Edit:

You posted while I was typing, so I'll quickly answer.

1) You can make as many applications as necessary. But if you are refused and then apply again you must deal with the reasons for refusal. Otherwise you will just be refused again.

2) See my answer above.

Hello GU22 and thanks for the help .. makes me feel more confident ... anyway my hubby and his parents have clean histories about public funds (as he said :o )

the website that I referred is in thai language My Webpage that really made me worried at first ... a bit silly tho.

- Only one point that he hasn't owned any property for a while after selling his house last 2 years .. tho he has a plan for some where to rent afterwards or we can stay at his parent's place as they gave us a kindly offer .. also they wrote me a letter to attach with the application ...

We have got many evidences to prove that we have been seeing each other for almost 1 year (got married recently) but I haven't kept any of telephone bills that we kept connecting to each other ( I actually got one to show that we sent sms's to each other) cuz I didn't realise that it would be fruitful ( tho i did now)

Thank you for spending sometime on reading this .. also waiting for some more idea cuz I will go to apply for this on friday .. very grateful for any idea ... :D

The OP is a troll similar to visalady. Why do they do it? It's neither witty nor otherwise entertaining. Presumably some mental deficiency.

the gent .. aren't you too shallow and narrow mind?? cuz people like you thats why thai girls can be only one thing .. only one suggestion to you ... respect people more !!! for some reason you might hate thai gals and I don't give a d*mn for that matter.. what I post here would really help me in the future ... one more thing I dont need people like you here ...

Wrong page! The page you have linked to explains the drop box facility, which can only be used if you have had the same type of visa in the last 2 years. Ignore it, it doesn't apply to you.

What you want is คู่สมรส-ข้อมูลสำหรับสามี, ภรรยา และคู่สมรสที่มิได้จดทะเบียน

Living with his parents will be fine, as long as in their letter they give a brief description of the home to show there will be room for you, and proof of ownership or tenancy agreement/landlords letter as appropriate.

The gent, I will reserve judgement on the OP's veracity until I hear from the Powers That Be. In the mean time I'll assume she is genuine. (Although the comments above dont help her cause.)

anyway thanks to all those who replied (she got a lot more than me!!..pretty face and all that!!..)

as for THE GENT ..... you should maybe give people the benefit of the doubt before you start shouting your mouth off !! . shes just a young lady who is trying to find a bit of info on her own..

maybe a name change could be in order!

calling people trolls because they say they are a thai girl, and are new on here, why do people do that, its neither witty or otherwise........

A definition of gentleman may be one who is never unintentionally rude.

I try to maintain standards and on occasion my attititude may strike some as a tad abrasive and a little difficult but gratuitous rudeness is not my style.

I have no problems with trolls per se not least because to a certain degree we are all trolls. However, trolling for the sake of it is tiresome particularly when it is clumsily expressed and to no evident purpose.

A case in point is the buffoon behind this feeble attempt. The character of Seredipity ( sic ) simply has no style and is as unconvincing as the deliberate solecisms.

Please try and raise your game if you are to succeed in engaging our attention. The fact that other posters have responded positively is more of a testament to their goodwill than anything else.

Until the next time?
