Hi just a quick question

I am just submitting a SV application now for my wife. Just trying to cover all scenarios

If the SV is refused what is the quickest way to gain the Visa

1) Appeal and send the relevant information which the visa was refused for

2) Re apply and submit the information requested so hopefully the visa will be granted this time.

I have read the appeal section on the Embassy website and it seems a long winded process sending docs to the AIT then a hearing will be set to hear your case. Seems like a several month process

Or is there a time limit before you can re apply for another Sv in Bangkok if so how long is this as it may be quicker than going through the tribuneral process

Again i am just trying to get some time scales if the application is refused hopefully it will be granted but knowing the options will be helpful

Don't know that I can answer your questions, sounds like you've read the details though.

What you should do is make sure you meet all the minimum requirements (and then some) to obtain the visa. That way you won't have to worry about what to do if it's refused. If you put forward a strong visa claim with no holes in, it's unlikey you will be refused.

If your really worried about not getting the visa, don't apply until your very confident!

Am sure some others can give you some help on your question though.

Its just my case is a little differant than most as i have been in Thailand for the last 12 months. I have put as much info in the app as possible with thanks to this site.

Its just a worry as my wife is also 4 months pregnant but i have been unable to submit app until now. So am just thinking of worst case scenario if i need to stay here while the child is born but am obviously hopping to return to England for the birth and get back into work also it would be a lot better for my wife to settle though the summer months rather than return in the winter months.

But i think i cover all the requirments so hopefuly it will not be needed

Jay, sounds like you won't have a problem mate. Not only have you been living together for 12 months (or ore), you are married and you have a child on the way. That's pretty good evidence of a genuine and committed relationship! I would think so long as filled in the form and added the neccessary documents, you have a very strong case.

I, too, don't think you should have a problem. However, if the visa is refused you should definitely appeal as that will be your fallback. What you can then do is write to the head of the visa section, setting out the reasons why you think the decision to refuse was wrong, and asking that it be reversed. If the ECM declines to issue the visa, you can then do the same but address it to UK Visas. Whilst there is an appeal outstanding, your wife is not precluded from making any number of applications. However, unless you can demonstrate that the reasons for the first application being refused no longer apply, any subsequent application is likely to be refused again.
