we're thinking of taking our kid to the US for a holiday. i

m US citizen and my wife is Thai with a 10 year US to B-2 visa already. she's been there once.

our 'daughter' is legally registered on the birth certificate to someone else (some crazy Thai shit). she's 13.

what do you think are our chances of getting a US tourist visa? i hate to spend the time and money if its a no hoper.

what would we need to bring? i assume some kind of letter from the 'legal parents' but not sure how that would work, i guess i'll have to call and see if i can get any info

it would be nice to know if anyone else has ever got a US visitors visa from a none relative minor

What is your status here? If working with Work Permit, good. If on a Retirement or Marriage extension of a Non-O visa, also good. All reflects that you're established in Thailand and would most likely return after the visit.

Also real important, does the step-daughter live with you and your wife? If so, good to great. If not, a bit of a negative factor.

I did the same thing last December with my two step daughters (5 and 6 years old) and the Mrs. having a B-2 with one visit to the US the previous year. We presented my 'O' visa (I know you live here too), and her B-2 with US immigration stamp. It was a slam dunk. They were in and out in under 30 minutes, both were granted 10 year B-2. Definetly worth your time.

Your step daughter will enjoy seeing the US.

thanks, that sounds promising. only thing is, it sounds like your wife is the legal mother of the 2 girls. my wife is actually the mother but for some insane Thai reason they listed her aunt and uncle as the parents (i think because they have government jobs so it was better for free health coverage and schools)

in answer to Mac, yes all of the the above, easy to prove i plan to come back here

by the way, i sent an email to the US embassy in bangkok and they didn't give my any clue what might happen, they just said its up to the interviewing officer

actually, a different but related question is there such a thing a legal guardianship in Thailand. maybe if we could get that, getting the visa would be a lot easier.

I believe you may adopt your daughter with the "father's" consent but I am not an expert in adoption.

One of my Thai friends had a son with a foreign father who was registered on the birth certificate in the pre-1992 Nationality Act days when that meant the boy could not have Thai nationality. After the marriage broke up, she re-married a Thai and he was able to adopt (took a couple of years) the boy and get him Thai nationality which, of course, he would have got automatically, if they had waited for the law to change but noone knew that at the time.

i got a reply from the embasssy

If the applicant wishes to be accompanied by the person who is not her legal parents, she must have the notarized consent letter from the legal parents to prove that the legal parents have been acknowledged and authorized to do so.

'

i don't want to adopt as i know that's a long, complex process. i've heard of something called a Por Kor 14 with is a child custody which i think can be done easily at the local amphur but i'm still looking into that

We would like to have our 14 year old nephew from Issan come to vist us for a year in the US. Would the tourist visa be the route to go.

Just now starting to look into what we would need to do to get him a visa. It would not be a problem to get the consent forms from the Mother, as my Wife is going to visit the family in Jan. He would likely come after the end of his school year.

I have been a member for years but never needed to ask a question. Thank you in advance for any replies
