Why is the relative of the rapist still not named and still employed?

He was the reason the assailant was hired. He was the one who fabricated the employment records.

He is the one who needs to be fired.

The SRT boss needs to be fired for negligence of duty. The relative needs to be prosecuted, not just fired, for his crimes that ultimately led to rape and murder. The fact that he has not been named yet is a disgrace and the army general is ultimately responsible for that disgrace. Edited by monkeycountry

The SRT boss needs to be fired for negligence of duty. The relative needs to be prosecuted, not just fired, for his crimes that ultimately led to rape and murder. The fact that he has not been named yet is a disgrace and the army general is ultimately responsible for that disgrace.

You would have a difficult time meeting all the elements necessary to prove negligence on the part of the SRT Governor. There is no indication he "knowingly" allowed any misconduct to occur. No one could foresee this tragedy as a reasonable foreseeable consequence. In the US, the manner in which he was fired would have been grounds for a wrongful dismissal lawsuit against his employer .

The relatives alleged actions of altering the work history of the assailant is not necessarily a crime but rather an employee offense of "dishonesty", which would be grounds for involuntary termination but not an arrest.

Ofcourse, I am using guidelines in developed Western countries--I do not know the employment laws of Thailand.

Since you consider the army general responsible for that disgrace, are you now suggesting it happened under his watch, continues to be happening under his watch and the buck should stop there with his being canned?

Agencies oppose capital punishment amid public clamour seeking death for rape-murder convicts

BANGKOK: -- THE GOVERNOR of the State Railway of Thailand, Prapat Chong-sanguan, was sacked yesterday in the wake of a shocking rape-and-murder of a 13-year-old on a Bangkok-bound train early on Sunday.


The National Council for Peace and Order (NCPO) announced his dismissal yesterday evening.

During the past several days, Prapat has been subjected to widespread public criticism not just because of his failure to prevent the horrific rape and killing but also because of his reaction to such crimes.

To date, Prapat has not offered any public apology to the victim's family. He initially tried to say that the attacker was an employee of a subcontractor, something that was exposed as untrue with clear evidence. Prapat also claimed that no serious crime had ever happened on a train before this case, which was denounced by a woman who was raped on a train 13 years ago.

Reacting to the calls for his resignation, Prapat also firmly insisted that he would not resign, reacting with anger against those who pressed for it.

Asked on Wednesday if he would allow his daughter to book a train berth, Prapat said, "I think no".

Meanwhile, despite strong public condemnation of sexual assaults, several agencies have resisted the growing call to put all rapists to death.

"It depends on the facts and details in each case," Charnchao Chaiyanukij, acting permanent secretary of the Justice Ministry, said yesterday.

People have been signing a petition demanding that all convicted rapists be executed in the wake of the recent shocking sexual assault on a teenage train passenger, who was murdered after the attack.

On Sunday, Wanchai Saengkhao, a new employee of the State Railway of Thailand, allegedly raped and killed the 13-year-old girl on the train he worked on, then threw her body out of the moving train, according to a police investigation.

Many people believe that capital punishment serves as a deterrent, but Charnchao said Thailand's legal sanctions were already as stiff as in other countries.

"Sexual offences range from sexual harassment, to rape, to rape with physical assault and to rape with murder. And the maximum punishment here is the death penalty," he said.

The strongest sentence would be handed down when there is solid evidence. "This means members of the public can help. If they get any information related to any case, please give it to the authorities."

Caspar Peek, the representative of the United Nations Population Fund for Thailand, said the UN opposed the use of capital punishment because it goes against human rights - particularly the right to life.

National Human Rights Commissioner Visa Benjamano said the law would run its course and society should focus on promoting a non-violent culture.

"We must campaign against the use of violence," she said.

Wanchai has been put in solitary confinement at Prachuap Khiri Khan Prison, pending the investigation into his alleged crimes.

A warden said on condition of anonymity that inmates there felt strong revulsion towards rapists and Wanchai would be at risk of being attacked had he not been separated from them.

No relatives have requested bail for him. His father, Suwat, just showed up to provide information at Noppawong Police Station.

Suwat reportedly told police that his son was usually quiet and obsessed with pornography.

"He loves watching porn. During the past week, he came home with more than 10 different women," a police source said.

One of Wanchai's co-workers also told police that some train crew knew about half of his plot to attack his victim.

"While drinking beer together during our work shift, he told us that this girl had caught his eye when she boarded the train in Surat Thani, and he planned to violate her sexually," he said.

Identified only as "Neung", the 19-year-old state witness has given useful information to police.

"After I noticed that the girl was missing, I asked him [Wanchai] about her and he told me that he had already thrown her off the train," Neung was quoted as saying.

Police have charged Wanchai with rape, murder, theft and drug abuse.

According to the investigation, Wanchai also stole the girl's mobile phone and tablet. He was allegedly an abuser of methamphetamines.

The girl's mother said she hoped Wanchai would apologise to her daughter before she is cremated on Sunday.

This is the first news release that provides evidence that other train crew knew of his intent to sexually assault the girl AND that atleast one crew was aware the girl had been killed.

Yet not one of them stepped up and attempted to prevent this tragedy.

I thoroughly enjoy train travel; however, I am not certain I can ever ride a Thai train again without having a strong resentment towards the car attendants.

This revelation is beyond comprehension.

For those who are wondering what happens to rapists in prison:

A suspect who was accused of raping his seven-year old step daughter was beaten to death at Trang provincial prison Wednesday night.

The suspect, Mr Prasin Noonkaew, who was accused of raping his step daughter on July 6 was held in custody at the provincial prison on Wednesday pending further investigation. He was however found dead in the prison cell the next morning.

Prison officials then alerted the police for an investigation and autopsy of the victim.

Police later said that Prasin was beaten to death by his cellmates, one of them identified as Worapong Suwan jailed on arson charge.

The due process should be that the actual people, I.e Human Resources Manager, the relative of Wanchai and the supervisor should take the fall, if this is a direct result of the murder of the poor little girl. However, SRT is a failing company that needs a massive overhaul , if they get the right person in, that clears the decks then so be it.

The sad thing is the more you research the accomplishments of the now "sacked" governor, the more one realizes he was just the guy to make the major overhaul and had started in that Herculean effort in his one short year at the SRT.

But its done now and he is gone. I am just relieved someone here on TV actually knows how its supposed to be done.

That's interesting. My research showed him to be just another red toady Thaksin acolyte, just like everybody else placed in positions of responsibility, such as good old Port chief Kamronwit. These people were not picked for their expertise in the specific fields.

Thaksin is not a businessman at all, he is a corrupt monopolist lucky enough to have been born into riches and power. Any notion that he is a "businessman" should have evaporated after he declared by him with-holding Thai rice for 3 years it would boost the world price and allow him to make a canny profit. LOL, is all I can say to such stunning stupidity and total lack of business/economic principles.

Sack everyone in the SRT who has failed to do their job and especially the HR department for hiring crooks all along, this isn't the first time an SRT contractor has done something very wrong. The entire organization needs a total overhaul, it has been dragging its feet for over a 100 years and I hope the 3 trillion baht infrastructure bill will be put to good use in totally revamping the SRT.

Why stop at the governor of SRT. Shouldn't the Minister of transport be sack for hiring such a stupid governor. Why stop here. Shouldn't the country leader be sack for the same reason, for appointing such a stupid minister who appointing such a stupid governor for employing such a stupid manager, for employing such a stupid supervisor for employing a rapist and killer.

If you do not know how he screwed up perhaps you should spend a little more time reading the reports, the news paper articles, even the posts on TV.

So back to: "How exactly did the top guy screw up?" For starters he allowed a system whereby the POS gained employment in the first place.

Where were the senior train staff and what were they doing to be blind to the fact that the perp was drugged out and pi$$ed to boot, were these people all effin blind (as they were certainly not doing their jobs)

There should'could perhaps have been separate carriages for females and unaccompanied minors, female security staff, in fact a myriad of things, should have been in place to mitigate against the likelihood of such an event.

And I for one am so pleased to see that he was fired and not transferred, as has for eons been the case in the realm.

I salute you Prayuth and ask that you continue to employ such decisive measures. And may you continue until the flotsam are but a bad memory.

No surprises with the public outrage, the buck stops at the top and this incident was too high profile to be ignored.

The head guy to blame directly but hes taken the pay check so it falls to him to take professional responsibility anyway.

Would have seen the same result no matter what,with such a high profile incident his time was done and this way he gets the payoff rather than has to break a contract which he may well have cost him money by resigning.

dosnt look like hes anyones fool by his track record and people need to remember hes not the one who killed anyone nor likely to have ever stopped it happening no matter what.

People just like to blame anyone remotely connected to such a murder but the truth is only the guy that did it is a murderer

True.. but he is an example.. maybe it will change things. (big maybe but better as inaction)

Other thing the guy said a few times he would resign if more trains derailed.. after that statement more trains derailed.

But yes he has a good track record.

I hope they also go after the guy who was the one that used his connection to get the rapist in the SRT.

You think the highest in command will be relieved of his command?

Of course, ultimately a CEO is the person to blame.

But, what about all those criminally inclined banksters?

The sacking of the governor is a knee jerk reaction, and not beneficial to the railways.

It seems that some people are confused about what is really happening here. The bigger picture. The junta will do anything to get the people on its side. The dismissal of the SRT boss is a perfect example. The junta's medicine of taking such swift and direct action, immediately creates a huge groundswell of positive emotions towards them as the saviours of the country. It's an old trick. You are therefore correct that this would not have happened before the coup. This medicine seems to be working well on many TVF members by eliciting just the right kind of gung ho, knee jerk reaction they are looking for. Well done junta! It's working.

Agree about PTP, but would not agree that this kind of retribution does not damage the country in other ways, by creating a witchhunt mentality. Far more insidious than losing a few baht.

Think this wicked crime was a chance to get rid of the guy who has done nothing to improve the train network since i have been here. If took at least 10 deaths at various train crossings here in Hua Hin over the past few years before proper safety measures were put in place.

How many trains derailed last year.. how many went unreported....

The saga of the new high speed rail link to the south which is no doubt being viewed as a chance by all high ranking officals involved as a get rich quick scheme, no doubt causing costings to be inflated and negotiations to break down.

Time to get a young smart guy in charge, maybe educated in Europe who understands how a great rail network can hugely help Thailand and all of its people.

As to the death penalty.. for evil people like this punk on the train... bring it on. This little girls parents will suffer for much longer....

Junta names Omsin new SRT chairman

BANGKOK: -- The National Council for Peace and Order (NCPO) has named former Thailand Post president Omsin Cheevapruek as the new chairman of the State Railway of Thailand (SRT).

Transport ministry’s permanent secretary Mrs Soithip Traisut said former Thailand Post president Omsin has been picked by the NCPO to take up the role as the new SRT chairman, replacing Mr Boonsom Lerthiranwong.

She said the change came after the incident in which a 13- year-old girl was raped and killed on the train.

It was time for the change as more earnest measures needed to be taken to ensure passengers’ safety after the incident, she said.

She also said in the bid to restore confidence among passengers, the DRT must intensify all safety procedures, starting from the screening of job applicants to security operations on board.

She said the tragedy happened because train security staff neglected their nightly patrol.

NCPO Chief Gen Prayuth Chan-ocha issued an order Thursday night dismissing SRT governor Prapat Chongsa-nguan from office, effective immediately.

So if someone else gets raped next week, this new guy will probably keep his job because he wouldn't have had enough time to stop people from getting raped on trains. But if someone gets raped in six months time, should he lose his job on the basis that he should have been able to prevent any further rapes in that time.

As she can't even get out of a car without ending up in a wheelchair, putting her in charge of a truck would be akin to assisted suicide.

This is quite possibly the best monday morning quarterbacking I have seen in a decade.
