Further to my previous thread (http://www.thaivisa.com/forum/topic/902685-visa-options-for-my-son-fiancee/) I now need to add my 1-year-old son to my Extension of Stay.

My son entered Thailand on an O visa.

Is there a form that needs to be completed, and, if so, do I complete it or should my employer (it will need to be my employer if it's in Thai)?

Do I need to take any other documents apart from:

My passport/Extension/work permit

My son's passport/visa

My son's Thai birth certificate?

You will be applying for your son's extension of stay as your dependent. You use the standard TM7 form with an attached 4 X 6 cm of him.

You will likely need proof form your employer you are still working for them to confirm your extension is still valid.

I've completed the TM7 form (for my son) and I have the photographs.

My employer is not being particularly co-operative, so do you think it will be enough if I produce my passport (which shows my Extension of Stay, valid until 30 November 2016), his Thai birth certificate and a copy of my contract of employment/salary slips? Or will I need all the documentation that my employer has to produce in order to get my Extension?

Since I think you will be applying at Chaeng Wattana you should at least try with the documents you have.

I think I have all the documentation I need, so I'm ready to make the trip to Immigration to get my son added to my Extension as my dependent. His O visa is valid until 26 July. Presumably I can go any time from now (15 June) to do this?

CW will normally do extensions up to 45 days early. I see no reason why you could not apply for his extension now.

One more question....

I was planning to complete a TM7 form, but the instructions my employer has given me (attached) say I should complete a TM86 form.

Which is the correct form?

That list is for a visa application not an extension.

From Bangkok immigration website. I assume your extension is under clause 2.1 which is for working.

In the case of being a family member of an alien permitted a temporary stay in the Kingdom under
Clauses 2.1, 2.2, 2.3, 2.5, 2.6, 2.7, 2.10, 2.12, 2.13, 2.14, 2.15, 2.16, 2.17, 2.21, 2.22, 2.26, or 2.29
hereof or Section 34(7) (applicable only to parents, spouse, children, adopted children, or spouse’s children):

Criteria for Consideration

(1) The alien must have been granted a non-immigrant visa (NON-IM).
(2) Must have proof of relationship.
(3) In the case of spouse, the relationship must be de jure and de facto; or
(4) In the case of children, adopted children, or spouse’s children, said children, adopted children,
or spouse’s children must not be married, must live with the alien as part of the family, and must not
be over 20 years of age; or
(5) In the case of parents, the father or mother must be 50 years of age or over.

Documents to be submitted

1. Application form
2. Copy of applicant’s passport
3. Copy of the passport of the alien who has been permitted to stay in the Kingdom
4. Copy of documents proving relationship, such as a marriage certificate, a birth certificate,
registration of child legitimization, household registration certificate, child adoption registration
certificate, or other evidence from the government or relevant agency

I've got all that and more as I have all the company information from my employer (contract, tax cert, plus lots of documents in Thai) that is usually required for my own extension, plus my work permit. Seems like this is not required but presumably no harm in me bringing it!

So which application do I complete for my son? The TM7?

My 20-month-old (British) son now has an Extension of Stay, attached to my Extension.  My Lao wife as an O visa and is permitted to stay until 28 December 2016.

 

My, and my son's, Extensions expire on 30 November, so we are going to Chaengwattana on 24 November, with my school's HR officer, to renew.

 

I'm assuming that we can also get my wife a one year Extension, to run in conjunction with mine and my son's.  Am I right?

 

Also, our UK (certified) marriage certificate did not have to be translated into Thai in order to get my wife's visa converted from Tourist to O.  Is this still the case for an Extension?

 

All my previous Extensions have been processed on the same day.  Is this still the case, or, like with visa conversions, is there a 14-day waiting period after the documents have been submitted?

Your wife should have no problem getting her extension at the same time as you and your son. She will have less than 45 days remaining on her entry which is CW immigration's policy.

No need for the translation to Thai since the marriage certificate is in English.

You will get all the extensions done on the same day you apply.
