Hi guys...after some general advice. My partner is in Australia with me on a tourist visa..,30 days into a 90-day stay. Can we apply for a partner visa while she is here or do we have to wait until she returns to Thailand? Any advice on the matter will be appreciated [emoji41]

If she can't be in Australia at the time of visa grant (when the visa is approved) then you need to wait till she is not in Australia before you lodge it.

You will need to take a look at her visa first.

 

If she has a "8503: No Further Stay" condition on it, she will won't be able to lodge the application in Oz.

 

If she doesn't have that condition, you can apply for it onshore.

I have helped a Thai friend whose Thai girlfriend entered on a Tourist Visa without the 'no further stay' condition. She was permitted to stay in Oz on a Bridging Visa, within 24 hours of application, whilst transitioning to a Temporary Partner Visa, which took about a year. Now she now married and a few months away from being granted Permanent Residency.

You can apply to get the 8503 condition waived but it's not easy.

 

All depends on the circumstances.
