Hi Guys

 

Hope someone can help me I have already had two tourist visa for my GF

 

My issue is each time i put a date on the Visa application they just approve it  without looking at the date ie I say she want to Travel 1/3/2016  I apply in Jan they approve it and say she has 3 months to travel from the approval date.

 

I now have the scenario the tourist sublass600 allows you to travel for no more than six months in a 12 month period

 

first visa she traveled 21Jan-20/04/2016

second visa travelled 22/07/2016- 21/10/2016

 

 

I want to apply for a third visa travelling starting 21Jan 2017 which  is the resetting of the 12 month period

 

My issue is if i start the process today based on previous applications I am afraid they will decline it because she has been  in the country for six months between Jan-December and not look at the date I am proposing to travel.

 

What is the normal procedure ?, what advice would  people give, apply in December/ early Jan or wait until after the 21st of Jan?

She doesnt have one now ,  each visa  has  been a 3 month tourist Visa subclass600  with no conditions attached

The conditions if any would have been listed on the email you got from the department notifying you of visa grant

I can't find anything in the legislation about traveling no more than 6 months in a 12 month period

If it is a real concern for you I would just wait till the 21st January to apply

I think you might be correct, I was positive i had seen  read or been told that it was max 6 months in a 12 month period on a tourist visa , However i have gone again over the conditions on the government site and it seems every case is on its merits, 

 

apologies if  ihave wasted anyone's time ,

Just something for your info.

 

As your girlfriend has already spend virtually half of the year in Oz, red flags will be raised by Immigration when they get her next application

in December or Jan. If you want to her to stay another 3 months, that will mean she would've spent approximately 9 months out of 15 in Australia.

 

Immigration may look at that as her not being a bonafide tourist and it would be hard to argue with them.

 

I'm not saying she won't get another visitor visa granted so quickly, it's just something to be aware of.

Just apply in January and make sure you add a piece of paper detailing her travel dates. If she is spending 3 months out and 3 months in, that's equal time. I don't see a problem if you highlight it for them.
