Innocent former teacher entitled to compensation

PEOPLE jailed and later found innocent of a crime are entitled to compensation, Thawatchai Thaikhiew, the deputy permanent secretary for justice, said.

 

Thawatchai said former Sakhon Nakhon schoolteacher Jomsap Saenmuangkhot – who served 18 months in prison for a 2005 hit-and-run crime that she did not commit – would be entitled almost Bt165,000 in compensation from the Justice Ministry, while her reinstatement as a teacher was up to the Education Ministry.

It's worth reading the extended article to see how they calculate compensatory fiduciaries.

 

Appalling scales.

She gets 300THB per day for wrongful incarceration [min wage].

 

You would hope there is a better right of recourse than this for something so egregious but maybe not.

Compensation??? be happy that you're not in jail.. no such word in Thai vocabulary

and no such edict in the Thai laws either, you're on your own buddy....

She should also get from the Education Ministry lost wages for being absent 18 months in addition to immediate reinstatement.

... and that's because it's exactly that, pathetic!

While according to the Nation-article she might be able to claim up to additional 130 grand in various damages it's still a bad joke. After all her life is pretty much phuket up entirely as it stands ...
 

Would also be interesting what happens to those tax-paid sorry excuses for so called 'law enforcement' who botched up that case in the first place!

A public apology would be very important. Money cannot compensate for lost life days.

And also public announcement and punishment  of those who brought her to jail. They should also compensate her appropriately.

 

And of course full compensation for the loss of her property because of imprisonment.

She was jailed due to a botched and lazy investigation again by the RTP and convicted by the again failed Thai justice system.

 

Just how many innocent people are in Thai jails just so the RTP can close off a case or to protect a hiso, or an associate of someone in power.

 

We all know how " efficiently" the KT trials were conducted.

 

The country is a circus at every level and on every issue.

I watched the police officer in charge of the investigation on television, he absolutely refused to apologize. His explanation was that the car that did the hit and run had the same plate number as the teacher, only a different province. They asked the guy who did do it and he denied it so off to jail she went. If anything she should get twice as much compensation from the guilty, lying scumbag as she gets from the government.

Try reading the article, compensation laws exist and apply!

Bt165,000 wow....

thats how much a life is worth in Thailand. This teacher has not just lost 18 months in prison. She lost everything, her pension, her reputation, and no schools are willing to employ her cos of her convict past.

Will the police who wrongly arrested and prosecuted a totally innocent person be punished or forced to help pay any compensation?

 

Of course not! Dont even imagine it. Absolute impunity for total incompetence.

If she is acquitted, then there should be a investigation into the original trial evidence and anyone who perjured themselves or tampered with evidence or just failed to do their job properly should be prosecuted.

How she was found guilty in the first place is a joke. Then the actual person driving the car admitted it but the RTP did nothing.

 

I saw another article today with a statement from the police "we cant help her its up to the courts"

 

And there is a very good reason why the RTP cant help her. They are too busy helping themselves!
