Hey All,

 

Just wondering if somebody with more experience than me could help me decipher my Thai girlfriend's Australian visa.

 

It states "Entries : Multiple", does this mean she can stay for 3 months, then if she flies back to Thailand and returns to Australia, she gets another 3 months?

It means that your girlfriend has a visa that will last for three months from the time she enters Australia. The total amount of time she is allowed to spend in Australia is 3 months. She has multiple entries which means she can leave and come back but she is only allowed to stay in Australia for three months. There would probably be a travel before date that I can't see on the notice which tells you when she must arrive in Australia ie you wouldn't be able to have two months this year and then another month in two years time or something like that.

Her conditions say that she can not work, she can study in a course that is 3 months or less but no more and there is a no further stay condition - once the three months is up you can not apply for another visa.

Basically she has a multi entry visa that will allow her to stay in Australia for three months only.

Not really the answer I was hoping for, obviously... she's currently over here on that visa and has a flight back to Thailand in late March... so then I have to apply for another visa? These tourist visas are becoming a drag... this is her 3rd tourist visa, we're getting married in March, also... could anyone recommend another visa to hold her over until we have the money for a spouse visa? I was hoping she'd be able to come and go in 3 month blocks all year on this visa she's currently using.

No sorry this is probably the only visa pathway available for her at the moment. Student visas can get quite expensive.

Immigration may also start to question the back to back tourist visas- I'm surprised you have got to three without any questions.

There is really no other option apart from the spouse - I sympathise it is a huge chunk of change for a piece of paper!

Yeah, not only is it expensive... but from what I've read it's a long process. Just want her over here while I'm in the application process, you know...

Yes 12 months is what the department state but many times it is completed before. Our prospective marriage visa was approved in 5 months (that was 10 years ago though). When you do your application the best way to help is to have a decision ready application- so that they can just look at it and make a decision - if they don't have to chase documents up then there are less delays.

You could always put in an application for spouse then have your girlfriend travel back to you on a tourist visa. The only gotcha you have to watch for is you will have to be in contact with the department to see when the partner visa is granted - often if you apply for a visa outside of Australia you have to be outside of Australia when the visa is granted.

Yeah, we've always submitted pretty comprehensive visa applications and intend to do the same for the spouse visa.

 

Sounds like the best plan is to get the spouse visa application in ASAP.
