My wife had our baby in the UK whilst on a tourist visa.

After receiving advice from this forum i decided to Pay for her treatment.
i payed £4600 to my local NHS  for antenatal , post natal and birth, my wife did not over-stay and left England with our son 
 
Now i'm unsure how to go about applying for her settlement visa. should she apply as the mother of a settled person or the partner of a settled person, dose it matter ?
 
i'm also unsure of how to explain the birth of our child ....  I need to say something but what should i tell them , should i tell them i payed the NHS , provide them with a bill ( which i don't have currently ) all i got was 3 little receipts. 
 
i have another question too ..
how much is the visa .... i've seen 3 figures on the .gov website  £1800, £1300 and £1100 ...
also..
Are the financial requirements still £18.600 .. didn't i read somewhere its changed ?

Partner of settled person. The figure is still £18,600.

 

The reason you have seen different figures are likely for two reasons. You pay the visa is US Dollars at a poor exchange rate and of course that goes up and down. You also have to pay the NHS surcharge. It's £200 a year. If you get married in the UK you have a fiancée  visa but it only lasts for six months with no NHS surcharge. The visa fee is 1518 USD.

 

The FLR six months later lasts 30 months and the NHS surcharge is £500 and you apply from within the UK. The visa fee is £811.00.

 

Getting married in Thailand it is different. The visa is 1518 USD but the visa lasts for 33 months, hence the NHS surcharge is £600. Rounded up, of course.

 

The costs are the same for a partner visa.

 

Tell the truth as far as the baby is concerned and explain that you paid for the treatment privately.

 She applies as your partner.

 

It does matter because she could only obtain a visa to settle as the mother of your child if you and she were to divorce or you died! See "Coming to look after your child" in Apply to join family living permanently in the UK; 3. Eligibility.

 

That she received care in a NHS hospital whilst here as a visitor would only matter if she had not paid for that care; in which case any subsequent visa application of any category would be refused until and unless she did pay. But she did pay at the time and you have the receipts. Explain all this in her application and include the receipts.

 

With regard to the lie in her visit application; as I said to you in the other topic explain that you made a mistake when applying for her visit visa and now know that she should have mentioned her pregnancy and intention to give birth in the UK in that application.

 

I would also explain why, as the intention was to give birth in the UK, return to Thailand after the birth and then apply for settlement, why she didn't simply apply for settlement in the first place.
