Hi my wife requires a replacement BRP because our solicitor lost it as well as both our passports . So the question i have can my wife get a replacement BRP with an old expired passport or does she need to get a new passport first . Secondly the BRP has been reported as lost but we are due to move address at the end of the month does she send away change of address before or after she gets new BRP . We are both in the uk , my wife is Thai .

If anyone can help , thanks in advance

What a bad situation! I would apply for the replacement after you move. Don't forget to give the solicitor the bill...

Yes it's turning into a real headache for us . Looks like we will be taking the solicitor to the legal obmbudsman as they're not taking reponsibility for the loss . We need to wait eight weeks to do that and my wife only has three months to get all this sorted unfortunately .

From Section 3 of the application form (page 8)

We can accept a BRP(RC) application without a passport or travel document in the following circumstances:

• the BRP(RC) application is made for a straight like-for-like replacement of a lost / stolen BRP or ISD (there are no change of personal details etc), and;

• The initial BRP or ISD was issued less than two years ago

• In all other circumstances your current passport or travel document and Biometric Residence Permit (BRP) must be provided, unless it is not available for one of the reasons specified on the application form

  But you are moving very soon; and that is a change of circumstances!

 

So, if she applies now, she wont need her passport; assuming her lost BRP was issued less than 2 years ago. But it is highly likely that you will have moved before she gets it before you move; unless she applies in person at a PEO.

 

If she applies after the move, she will need her passport. But as she has 3 months in which to apply, she will probably have her new passport by then.

 

The Home Office should have contacted her within 1 day of her reporting her BRP lost to them. Did they, and did you or she explain the situation over the lost passport and the move to them? If so, what did they say?

The only contact we have had with the home office since she reported it lost was a generic email explaining that my wife has 3 months to apply for a new one . I have searched online and there does not seem to be a phone number in which we can contact anyone to explain the situation .

   We are holding off till monday to report the passports missing as royal mail has launched an investigation into where they are . Only doing this in the hope they might turn up and make the situation a bit easier . Getting a replacement passport means traveling from Scotland to London

Ok i finally managed to get to talk with someone . Turns out she needs a new passport to apply for a replacemant BRP , then she lists change of address on appliaction . Sounds simple enough
