The situation:

 

The child was born in Australian to an Australian father and a Thai mother. Later the Thai mother returns to Thailand, abandoning her husband and child.

 

The father decides to move to Thailand so the child can have some contact with the mother, ( this hasn't eventuated as the mothers whereabouts are unknown).

However the father is legally working in Thailand and has full time employment. The child came in to Thailand on a 3 month visa, this is several years ago, when the father visited the immigration office about how to sort out a visa for the child, he was told not to worry about it until the child was 14 years old.

 

However it is a worry to the father and the years are passing. By e mail some years ago the mother was asked to sign documents so the child could be granted his Thai citizenship/nationality, she refused.

 

The question is, Is there any way foreign children can be granted a visa if they are here with working parents, or in this case a working parent (singular).

 

Before anyone asks about the Thai citizenship, the father has been to many various departments, and without the mothers signature, the child cannot be granted Thai citizenship/nationality.

The child of a person working here with a work permit and extension of stay (not a visa) can get an extension of stay as their dependent. They first would have to leave the country to get a single entry non-o visa at an embassy as the dependent of the parent.

 

Was the child's birth registered at the Thai embassy in Australia? If not it would not be possible to get them Thai nationality here without it being done to get a Thai birth certificate. It is possible to apply for the birth certificate via the consular affairs department of the MFA in Bangkok.

No, the birth wasn't registered with the Thai embassy in Australia. So am I correct in saying in that instance it would not be possible to apply for a birth  certificate via the consular affairs Dept .

 

Thanks for the other info, if the child left Thailand to apply for a single entry non-O-visa, would the parent need to be present in another country, in other words could this be done with say a grandparent, or would the father need to be present and what paperwork would be needed.

The birth certificate can be applied for through the consular affairs department. They will accept the application and send it to the embassy in Australia for them to issue the birth certificate.

It would be best if you were with them when they apply for the visa. Parental consent is needed for the visa to issued.

It  will require their birth certificate plus a copy and copies of your passport photo page and extension of stay stamp.
