Thai courts

Does anyone have any knowledge/experience of Thai courts, in particular relating to attitudes to personal debt.

 

I think western courts show much sympathy these days for individuals who borrow too much especially if they think banks have been irresponsible by lending too much, so I wondered if Thai courts would have a similar attitude (for a Thai person, not Farang!).

 

All I have read and heard before about Thailand suggests they are very tough on crime, but is that just for the serious stuff?

When it comes to personal debts Thai courts will not be much help to you

as usually personal debts are not well documents, the law is tough

on people who cheat, or obtain goods and services by deceptions

in lieu for full payments than you have a leg to stand on, and you will

need a lawyer to represent you, while personal debts are hard to prove

and deemed to be a private transaction among friend and associates

and therefore not enforceable...and unless you can negotiate with the

other party to pay you back in any amount at in any time, your chances

of getting this money back is close to nil...

Thanks for reply but you misunderstand my question, also it's just a question and not a statement of fact.

It was prompted by a Thai person I know who is likely to take out a large loan that they can't re-pay and so I wondered what will happen when the S hits the F and they default on the loan.

This can't be uncommon in Thailand where so many families are poor and health costs can be relatively high.
