Hi guys,

 

Apologies if this has been covered but I searched and could not find it anywhere. Happy to be redirected, if so.

 

Moving back to the UK (I know, bad time for it!) with Thai spouse and dual citizen son (5 years old). I meet the financial threshold with my current employment in Thailand and have a potential job in the UK that also meets the threshold, and starts within 3 months of my return. 

 

My potential employer in the UK is asking me what they need to do. I now I'll need a cover letter and a signed contract from them, but what else should the company expect in terms of follow up from the government on this? They just want to know what to expect and wonder if it will be a call, an email, a visit or some more official.

 

Also, is the official title of this visa "Spouse Visa" or something else? I found it strangely difficult to find an answer on the government website.

I'm assuming you've read the guidlines, you'll need 5.4.1 onwards, this explains the procedure and what evidence you need to produce.

As to whether the prospective employer would be contacted by the decision makers in Sheffield, I really don't know but I wouldn't have thought so, maybe somebody who has been through the process recently could comment.

Your wife would need to apply as the the Spouse of a Settled Person, even though you're not currently living in the UK.

Thanks for the reply and info OG. I thought the visa was called that but it seemed a little misleading because I wasn't settled, as you note.

 

You're right however, I'm mainly looking for info on what will be asked of the company that signs my contract, so if anyone has recently been through this and has the info, please let me know. You'd be my hero! ;)

 I assume these are two different employers, in which case, as theoldgit says, you come under "5.4. Category B: Less than 6 months with current employer or variable income – overseas sponsor returning to the UK" of the financial requirement

 

Remember that you will need to supply evidence of your employment and income from your current job in Thailand.

 

See Immigration Rules Appendix FM-SE: family members specified evidence for what is required; Paras 3 and 4 of "Evidence of Financial Requirements under Appendix FM" being specific to your situation.

 

Anyone who supplies evidence for a UK visa application may be contacted by UKVI for confirmation of that evidence. Whether they will do so in your wife's case, i don't know.
