E-cigarettes included in Phuket beach smoking ban

PHUKET: The use of e-cigarettes, also known as vaping, on Patong Beach will be considered the same as “smoking” and offenders may incur a fine of up to B100,000 or even a year in jail, a leading local Department of Marine and Coastal Resources (DMCR) officer confirmed yesterday (Nov 9).

 

Vaping in public is already illegal in Thailand as it is by law already considered the same as smoking, Watcharin Thintalang Director of the Phuket DMCR’s Marine and Coastal Management Division, told The Phuket News.

 

“E-cigarettes, or vaping, create smoke and that is banned under the same DMCR regulation (for banning smoking at the beaches). Vaping is ‘smoking’, and that breaks the law,” he said.

Which is it? They don't want people smoking because of cig butts littering the beaches OR they don't want people to smoke, period?

 

This new law was put in place because of littering... As far as I know 'vaping' does not litter.

Once again, stupidity taken to extremes. The whole idea of the no smoking is to prevent litter and keep the beaches clean. I fail to see how an e-cigarette in any way falls into the bracket of causing litter. Looks like another attempt to just gouge money out of people, while showing the extent of the locals limited brain processing abilities.

10 years for having an e cigarette  and 1 yr for smoke it on the beach...

ohhh i think i can go lifetime to prison and surrender to police..................

It doesn't, but they have been trying to ban it and just can't seem to get people to go along. 

 

The buffoonery of Thai officialdom is quaint when you first arrive in Thailand, but it gets old rather quickly.

Lets just keep on keeping on with new laws to relieve foreigners of their hard earned cash.... it's nothing to do with clean beaches as we all know only too well!!

Yep. And mine doesn't even have any nicotine in it. But a local could still go to jail for 5 years for puffing on one, as opposed to a 500 baht fine for using the pipe to gouge out someone's eye in a fight.

Vaping is treated the same as smoking cigarettes pretty much everywhere. Like in the UK vaping falls under the sae regulations as smoking, yet it does not fit with the reasons the smoking ban was brought in.

So Thailand is doing what absolutely every other country does. But don't let that stop you complain about the "Thai stupidity" of it. 

I'm happy that this at least indicates there is some leeway on e-cigarettes here, and it's not out-and-out illegal. Yea the stance on e-cigarettes is still uncertain, but how Thailand operates is part of what makes it a nice place to be. 

Like almost every country, the thing that makes it great is also the exact thing that makes it bad.

Can anyone actually tell me the law about e cigarettes? Are you actually allowed to use one at all or even bring one into the country? Seems to be lots of confusion.

Exactly. The government banned the import, sale and use of E-Gigarettes and liquids months ago. Banning 'vaping' on beaches is acknowledging that it's Ok to be in possession of the kit and to use in but not on beaches under the penalties dictated.

A few years back I was in a pub in Hong Kong watching football, I was vaping my e-cig and was allowed to do so. In the couple of hours I was there 2 people were told to leave because they lit up a cigarette, I noticed them both lighting up and they did it because they saw me blowing out smoke and assumed smoking was allowed. 

This is partly why e-cigs SHOULD be treated like cigarettes. It's easier all around to treat them the same.

So, if you can't buy them and can't bring one with you how is it possible to legally own one?

You can breath as long as it is first approved and as long as it is not near any person of authority. You will also require a permit for this action as it could be seen as contravening a gathering of more than 5 people breathing. You can however breath at will if you have many friends who will support you breathing wherever you like.

Sorry, but I disagree. I have to stock up on my vape supplies whenever I go back to the UK, where I can openly vape without fear of prosecution.

The ultimate goal, which they haven't worked out yet, is how to have farang money without any of us being in Thailand. I'm sure they are working hard to find the solution.

Very good point mike1967 but they have already figured that one out - referencing a TV article about closing and taking the money out of inactive bank accounts

Just read this in another thread. Seems there is to be some confusion which I am sure someone will capitalise on.

 

"Pattaya clearly was unprepared to do anything about smoking on the beach. By Nov. 2 no signs had been erected on any beach and plenty of sunbathers and vendors were puffing away as normal".

You disagree that places that prohibit smoking in the UK also prohibit vaping? I mean, you can disagree if you like, but that just makes you wrong. 

Yes I'm well aware that you can't buy e-cigarettes here, but that's not what the thread is about. It's about vaping being included in the beach smoking ban. Which is just the same as vaping being included in the smoking bans everywhere.

Yes I'm well aware that you can't buy e-cigarettes here, but that's not what the thread is about. It's about vaping being included in the beach smoking ban. Which is just the same as vaping being included in the smoking bans everywhere. 

I'm not wrong. In the UK it is illegal to smoke inside pubs, but I can vape. Granted, not all pubs. But I know plenty of pubs that are fine with it.

Don't forget, there is another bright side.

You are still allowed to inhale the clean fumes from the Jet Skis, boats and motorbikes that travel on the beaches, not to forget the proximity of the beach road.

Stop moaning, life is beautiful on and close to the beaches.
