My Mrs is still recognised as married to a foreigner in thailand as there marriage was registered here.

 

Problem is they got divorced in Japan and guy sent wrong docs to her and she cannot present these to be declared divorced in thailand. The guy also will not play ball amd this has been over 3 years

 

Is there not a way we can petition the courts to recognise her as divorced/free to marry since thry have not even spoke in over 3 years?

Maybe Ms would better cover all bases since she's not officially divorced.

Why can't she contact the office in Japan where she got her divorce and get them to send a copy of the divorce certificate to her or maybe she can do that through the Japanese Embassy. She maybe able to get a declaration from the Japanese Embassy stating that she is free to marry as her divorce was in Japan

If not recognized in Thailand by an sor sor 22 documente, it never has been recognized in Thailand.

If either party can't file for divorce for abandonment , will take two years for application at the Amphor.,

Both agree , five minutes at the Amphur.

In either case I would recommend to wait two years to lapse before she marries again.

Being in love doesn't come from a piece of paper.   Not getting married doesn't mean a person uses bargirls or can't monogamous.

No you cannot do that. It is very difficult to do this in japan which is why we are looking at other options

Responsibilities, assets, business, children, security should one pass in an untimely manner.  Just a few reasons to get married and make life easier in the event of.

Hi PS, how could we confirm if such a document exists? I am assuming it does as we had issues with our sons surname but we solved it but they stated on their system she is classed  as married.

I would take the OP's advice and consider to get the aircon revised, see that those tinted glass windows are in good shape, have some good stocks of water [and booze mixers] in the storage area, get the pool and the pumps checked and have enough high protection "La Roche Posay" sun block antiUV creams from Europe which IMHO are the best. Also make sure to have enough straw hats and caps, that the garden fans are working and everything will be fine to enjoy a great summer with good food, good booze and amazing chicks in the pool :cheesy::jap:

Good excuse to put off marriage for at least that length of time. After 2 years one should know if one still wants to get married.

If she was legaly divorced in Japan she is legaly divorced here.  The problem is the documentation.  It is probably worth checking the ID card.  If it says Mrs she was recognised as married here.

Anyone can apply to the court to divorce here after 2 years but as she is already divorced she cannot.

The problem is getting the Ampur to recognise the documents if they have already recorded her as married.  If not she should be able to get married.
