Wonder if it's all legally built ? Interesting that they advise the executives of the company headquartered in Berlin but as we know they must be operating as a Thai company in Thailand so hence have 51% Thai shareholding. Their Thai homepage give no information as to the name of the Thai company who must be operating this venture. Wonder who the Thai shareholders are ? Obviously not nominees as that would be illegal but maybe people of influence hence being able to gain permission to build on the beach front perhaps ?

It's a rather large hotel company comparable to Hilton and co, u can be assured they got their legal structuring done correctly.

You do not need Thai shareholders for this, you can simply run a BOI company. 

The whole thai company nonsense is only to keep us small private investors down down, it doesn't apply to rich corps.

 

That said, there's no such thing as a private beach in Thailand, and most of the rest of the world. You can't own a beach here, it's owned by the government. What u own is the land after the beach ends, it's bs advertisement.

Well having been involved in that process in "earlier lives" registering a BOI company is hardly simple and I just had it checked  and couldn't  find Mason as a BOI registered company, or perhaps operating under another trading name ?  Also only under specific circumstances is a company able to undertake BOI registration with only non Thais as directors.  The hotel business is not one of those exceptions so hence if the company is operating and registered as a hotel business it will indeed require Thai national participation.

 

As you seem to be involved perhaps you could advise the operating BOI registered legal entity in Thailand or else  advise whom the Thai shareholders are if just a conventional Thai registered company, just for clarity of course.

Why would i be involved lol? i only know design hotels as its a german company. they dont seem to own hotels, its just a club u can join with a hotel you own urself as far as google told me.

 

As i said their private beach advertisement is bullshit and should be forbidden, you can't legally stop people to go on a piece of public government owned land ... all they have is a bit of fancy sand after the gov owned beach they've prolly put there themselves.

Which one? Design hotels is just a club for design hotels that does marketing etc.

 

that hotel seems to be owned by a normal thai company...nothing special imo except the usual bs private beach advertisements

However desirable this place is, will the tide wash in the usual plastic and other rubbish onto the "private" beach? Do the Chinese qualify as residents?

ambition over reality. or perhaps wishful thinking over common sense. Good way to launder dodgy money, can't think of any other reason for building it in Pattaya.
