Transport Ministry seeks Hopewell case retrial

BANGKOK (NNT) - The Minister of Transport has revealed the Ministry of Transport will ask for a retrial, after a court ruling requiring the government to pay Hopewell 25 billion baht, citing new evidence in an abandoned tollway venture.

 

The Minister of Transport Saksayam Chidchob, has disclosed the Ministry of Transport has filed a petition for a new trial, with the Department of Special Investigation and the Administrative Court against the last verdict requiring the Thai government to pay compensation to Hopewell Thailand, the contractor in a cancelled transportation project in Bangkok in the 1990s.

 

The Supreme Administrative Court, had previously ruled that the Ministry of Transport and the State Railway of Thailand were liable for 25 billion baht in compensation, which had to be paid to Hopewell Thailand by 19th October 2020. A retrial petition has already been filed and rejected by the court.

 

The Minister of Transport said a new retrial petition is now being filed, citing new evidence the ministry has obtained on the company’s objectives.

 

Hopewell Thailand has already demanded the compensation be paid within 15 days, followed by a legal execution process should this request not be fulfilled. The Minister of Transport said the Ministry of Transport must follow its protocol, and welcome any legal execution process, as the Ministry will pursue this case to the end in order to protect the state’s benefit.

 

A request was made two weeks ago to the Prime Minister to set up an investigation panel to identify persons involved in this dispute. The Prime Minister is reportedly considering the request.

20+ years this has been going on, it was appealed, it was ruled on and then it was affirmed by the Supreme Administrative court, and all of a sudden 25+ years later there is now new evidence.  Can someone please tell this Government buffoon just to pay what's owed to a company who suffered damages because of the Government's cancelation of the awarded contract back in 1998 by the SRT after they had already sunk billions into construction.

Are we seriously expected to believe that the state dies not know who was involved in this dispute?

 

No need to set up an investigation panel - just read the transcript of the court case!

The interest on the basic amount of compensation awarded has already exceeded the basic award (ie., Rule of 72). I believe the interest rate is circa 7% pa.

As the nonpayment continues due to delays by the TM, the interest obligation should shift to the TM  personally should he fail to get a court mandated eliminated or substantially reduced basic award amount. Personal obligation for failed government policies that create financial obligations was a policy established by the Prayut junta, ie., assessed against former PM Yingluck. So let it be again.
