My Partner entered the UK in June 2020 with a fiancée visa, on the condition that we marry within 6 months.

 

We are now married and looking to upgrade her visa to settlement without her having to leave the UK.

 

I'm a bit confused as to which visa to now apply for,

 

I thought it was the family visa but it's asking me lots of questions about If her child needs a visa and what date they entered the UK.

 

This is obviously not relevant to us so can anyone point me to the right visa to now apply for.

She needs to apply for leave to remain, I think this is the form.

The UKVI advises that whichever option you choose you will be asked questions about any children you have and your private life. You will also be able to tell them any other reasons you want to stay in the UK.

This is in fact the same form I'm filling out, the issue I have is it asks the question,

 

"When did your child first enter the UK"

 

My partners child has never entered the UK and it does not allow the date format "DD/MM/YYYY/ to be left empty.

 

So basically anything I enter into the date box is incorrect but I can't bypass it.

Does her child want to go to the UK in due course?

 

Did she mention the child when she started the application, I think that once the child is declared it stays there.

It asks the question,

 

Do you have any children under the age of 18      (Yes)

 

Will all of your children be joining you in the Uk?  (No)

 

Why will all of your children not be joining you in the Uk?  (blah blah)

 

What date did your child first enter the Uk?  DD/MM/YYYY

 

 

Her daughter has never entered the Uk
