Dear all,

I will appreciate if someone can give me advice.

I am with a retirement visa “O” Married with Thai lady and have a kid. I have been contacted by a foreign company I used to work for to install an industrial machine near Bangkok wish will take about one month.

I will get paid by the foreign company in a foreign country, what should I do to be as legal as possible.

Get the company to ask the labour office not Immigration.

A work permit is possible with your visa/extension.

Doesn't need to leave anywhere.

Ask the local labour office.

The legal requirement for a wp is a Non Immigrant Visa/Extension.

Imm' always say must be B visa and that is totally wrong. They dont issue WP's

Thanks but I’ll not go out Thailand and quarantine for one month job

Read carefully. It's not exactly clear if he has a married extension or retirement extension.

PS 

Hay  is for horses.

Plus it is not unknwon for some offices to issue a wp on retirement extensions.

It depends on the local office.

Whatever you end up doing now I'd suggest you make sure your next extension is based on marriage not retirement. That way you can work if/as opportunities arise. In addition finslancial requirements are lower.

I believe up until a few years ago that Imm' used to stamp 'employment not allowed' on retirement extensions. Nowadays they don't seem to do that.

Maybe a good lawyer could argue the point for a wp on that.

About five years ago, a friend of mine was hired locally and although married here, he was on a Retirement Extension. It took a lot of work by his Bangkok employers and whatever local immigration and labor offices they dealt with to get his Ret Ext 'converted' to a marriage one so he could get the WP and work 100% legally. That was with quite a large foreign company that had been registered and trading here for decades, initially with BOI privileges.

 

I have recently heard that getting WP's for a non- BOI listed foreign cmpany isn't as fast as it used to be, ie. not impossible but may take longer than before? I had a client here a few years back that insisted we as a team of about 45-man crew, technicians and specialists, all get the "proper" visas and WP's for a planned 28 day offshore job that we wrapped up several days earlier because we simply exude excellence. It actually took longer to issue and process all the Non-O visa and WP paperwork, get the associated medicals then subsequently surrender the WP's and close out the project staffing issues than the actual bloody project itself. Bureaucratic madness!

I don't think could get a work permit even if he qualified to get one.

If it did not involve on-site work, I'd advise gong ahead and doing it without a work permit given that he will be paid from abroad. But with on-site work in-country, too risky, not advisable.

 

Do  they have some local affiliate?

 

You are going to need to change the extension to an extension based on marriage then get the paperwork for a work permit.

Just do the one month work..say nothing...I am sure you would not have a problem.

At the same time in what I say if you did longer problem maybe......

Take the money and say nothing....

Thank you. Was looking for most inadequate post of the day. This is clear winner.

The OP is married and also child. Asked for safe advice.

That has been given. He cannot work on extension based on retirement.

Your advice is reckless at best, however I'm sure that the OP would dismiss it in a heartbeat.

I too was offered " casual " work in Thailand not long ago. Money paid outside the country , but all done without the proper permit.

But with people grassing farangs up for any reason , I thought I had to much to lose ,

the money would have been great , but I had to weigh up the risks.

This says it all, you are NOT allowed to work in Thailand, you are "retired".

 

If your extension of stay was based on marriage, you were allowed to apply for a work permit.

It's not allowed to work on a retirement visa/extension of stay. But everything is possible.

So did you look in your passport to see if you have retirement visa or a retirement extension of stay ,we are none the wiser still
