Depends on the origin of the leak, is it coming from above (unit above responsible) and running down the outside of the pipe, or if the pipe/T junction is leaking , then its a condo building fault, a common property drainage pipe.

The definitions can be unclear, but the office should be able to decide. It wouldn't usually ever be the responsibility of the bottom condo.
