You should be able to get a replacement BMS, but of course it would have to come from the pack manufacturer in order to drop in (Seplos sell packs, case kits and BMS's but they are not cheap).

 

If it's a failed cell it could be a problem as most packs use welded cell connectors, very reliable, very hard to DIY a cell exchange.

Is it ok to stack this batteries so poles point forward instead up upwards? ( the largest side down. 8 up an 2 rows,,

No problem, terminals up or terminals horizontal but not terminals down (messes up the venting).
