Urgent advice needed

I am at the Ban Laem border with Cambodia at the moment. The second time in the row they refuse letting me out of Thailand. The same happened at this border 3 weeks ago. I am on 2 weeks overstay. They say I need to go to the “big border”.  How legal is this? If I go back now and stopped by the police - I will be in prison for overstay.

Do they really have a right to prevent me crossing the border without any legible reason?

You are in a se Asian country, they have the right to do whatever they want. Personally I’d go to the airport and pay the fine and fly out, then return when eligible. Though your entire circumstance isn’t explained.

Seems to me they would be following their own regulations, somethink like 'Foreigners on overstay cannot leave the country without specific processing which must be done at a main airport'.

Your in Thailand you have follow/respect Thai applicable laws.

 

Same applies in any country including in your own home/birth country.

Yes they have a right to prevent you from crossing the border, and leaving Thailand. Immigration needs to follow a certain process to allow you to leave, and in your situation/circumstance, they can't process your departure at your selected border point.

I've seen people pay overstay fines at the Ban Laem checkpoint before and there's a window for that, did you queue up at that window first and they sent you away?

 

Either your overstay is too long or they are worried that you want to come back immediately, as that's a border crossing that's popular with border bouncers. They might let you out if you assure them that you'll stay in Cambodia.

 

Otherwise I'd say fly out, that's the most hassle-free way to resolve an overstay.

The land border at the train station in Mukdahan -Savanakhet doesn't accept overstays fines , you need to go to the main border .

Why didn't they "let you out" 3 weeks ago as at that time you were not on overstay.

I asked what am I supposed to do - and he told me to go to Chaeng Wattana to transfer the stamp and to get 7 days extension then leave the country.”

Seems to me he can't get overstay processed at any land border, can only be done at a major Thai international airport.

 

He broke Thai law, he overstayed, which is serious in any country and subject to fines, blacklisting etc. every country.

 

Now he needs to follow the appliable/specific Thai laws, must get the overstay processed at a Thai international airport.

If you don't want to go anywhere else, then look if you find a friendly visa agent who maybe like to help you - for a fee of course.

 

And about legal or illegal or whatever: What are you going to do? Tell them that what they do is illegal? Or go to the police? Or what's your plan?

Leave by air from Don Muang airport to Vientiane. Obviously, you will need to pay the overstay fine. Assuming you have not used the two allowed visa exempt entries in 2022, you can then enter Thailand via the Friendship Bridge to Nong Khai. Total cost: 500 baht per day  for the overstay, probably 3,000 baht for the airfare (short notice), US$40 for the Lao visa on arrival, and whatever it costs you to return overland to Bangkok/Pattaya (where I assume you live).

 

If this method is beyond your financial means, it might be possible to find a cheaper solution, but it would be high risk. Avoid getting into a mess like this in the future.

have you tried pong nam ron, about 20km south, is it because they will not let you return due to too many entries

Just fly out ASAP they are searching for overstayers. They caught an 8 day overstayer a few days ago

At Ban Laem they do. I've seen people pay overstay fines there.

In any event the OP who posted "urgent" has not contributed and not been online for 4 hours.

Hopefully making plans to travel to airport to settle overstay.

Thinking one plan suggested by @BritTim earlier made lot of sense.

It will help him in the future not to get into this situation by not overstaying his visa. He asked for "advice" and he got "advice" or the future of what to do in the future to not get in this situation.

 

The OP was also apparently offered advice as per the below, not by some randoms on an internet forum but from an immigration official, but didn't seem to take on the advice:

Did you see a previous thread by OP? It's the second time they haven't let him out. The first time he didn't have an overstay. They just said he had too many covid visas.

There is a saying along the lines..

"The definition of insanity is doing same thing over and over and expecting a different result".

 Well, after paying overstay and some angry talk, I was finally let out. Tried to return through another crossing (today) and was stopped. Was advised by the several IOs today that I can come back by plane - but do not think that I will risk it (not a fan of spending 24+ hours in the immigration police airport prison).

 And I actually planned to leave Thailand (most probably, forever) in the end of December - beginning of January. So, not a big tragedy. And there is one positive bonus: do not have to think of the credible explanation for my tgf. 

Thank you, Thailand , for everything. Great place, great people and culture, great memories. But we humans get tired and bored even with the greatest things. It is time to move.
