Move Forward Party could breach Charter by opposing transfer of official

The Bhumjaithai Party’s registrar has warned the Move Forward Party and its leader, Pita Limjaroenrat, that they may be accused of defying the Constitution, if it interferes with the transfer of Public Health Ministry officials.

 

Yesterday (Thursday), Move Forward issued a written statement, signed by Pita, opposing the Ministry’s transfer of Dr. Supat Hasuwannakit, director of Chana District Hospital and head of Rural Doctors’ Society, to the post of director of Saba Yoi District Hospital, also in Songkhla Province, claiming that the move was politically motivated.

 

The registrar, Suphachai Jaismut, explained that transfers of officials within a ministry is a common occurrence in the state sector and the transfer of an efficient official for the benefit of the people is quite normal.

A typical characteristic of an authoritarian regime is hypocrisy in law.

In 2014 the Constitutional Court removed democratically elected PM Yingluck from office because she acted illegally when she transferred her national security head (to I recall to the PM's Office).

The Court (and Democrat Party) argued she did so to place a relative into the position for the benefit (never explained) of the relative. But the position serves "at the pleasure of the PM", no reason for removal was required nor was the person required to still hold a government position. The Court also for the same reason removed nine of Yingluck's Cabinet members, essentially gutting the Yingluck administration.

Coincidentally, just prior to a general election "redo" ordered by the Court when it invalidated Yingluck's election months earlier and about a week later, Gen. Prayut led a military coup to install himself as PM.

It is impossible for an official to remain in a post at one place indefinitely, he said, adding that transfers are based on regulations, suitability and for public interest.
