Polling Agency Wants To Knock Out Move Forward: Rangsiman

MOVE FORWARD spokesman Rangsiman Rome this evening (June 10) said the Election Commission’s decision to investigate whether party leader and prime minister-designate Pita Limjaroenrat had violated sections 42(3) and 151 of the election organic law was tantamount to kicking and trying to cut off the party’s legs but this will fail, TV Channel 7 said.

While the polling agency will likely verify Pita as MP along with the others, it remains to be seen whether it will lodge a criminal lawsuit against him for allegedly being disqualified to contest the nationwide election, given his holding a 0.0035% share in an off-air ITV channel.

Attacking Move Forward this way is clearly a political move, Rangsiman said, but pointed out that as the accused is innocent until proven guilty Pita could still become prime minister with court procedures taking a long time.

The EC will have to endorse Mr Pita as a list-MP as part of the election process and then consider if he is qualified to hold the post.

However, the EC can investigate a criminal offence against Mr Pita, saying it can consider if he has violated Section 151 by applying as a list-MP candidate despite knowing he may not have been eligible to run for the House seat.

"The EC can't consider Mr Pita's status as an MP because he isn't an MP yet. If he is endorsed and the EC has questions about his qualifications, it can ask the Constitutional Court to rule,"

It's ironic (some might say undemocratic) that an unelected body can decide electability of candidates. Thst's not to say the EC can provide "even-handed" relevant documented information about candidates that complies with Thai "fake news" and Computer Act laws.

But ultimately, it should be the body of the electorate (the voting public) that should make that decision at the ballot box. Some might argue such political lattitude might allow alleged criminals into public office. But how was that different from 2014-2022?

Well it is the same in every country...What is the alternatives? That the ruling parties can decide the electability?

Meanwhile Thai industries,  other S.E.Asian countries, the rest of the other trading nations are waiting for Thailand to stop playing games and come out with a final verdict on the outcome of the election  so that life can continue.

Thailand is fast becoming a laughing stock of the world with it's party games.

SEA countries waiting? Laos, Cambodia or Myanmar the hubs of democracy? Or Malaysia with the Sharia the hub of human rights (and read the political drama there after Mahathir) ?

(1/3) Move Forward will hold a press conference on ITV media stocks held by its PM candidate Pita today at 10am. The move came after TV3 on Sun released a voice clip showing a major inconsistency in the company’s annual shareholder's meeting on April 26.

Correction: video clip, not voice clip

(2/3) At ITV’s annual shareholder's meeting on April 26, the written report quoted a top management saying ITV is still operating as a mass media organisation while the voice record clip said that they are "inactive" due to ongoing legal issues

(3/3) The EC is considering whether Pita knowingly applied to compete as MP candidate knowingly that he's not qualified due to his holding of ITV shares. If found guilty by the court, Pita could be sent to prison for 10 yrs & have his voting rights suspended for 20 yrs.

Apparently two days before the ITV meeting, a Bhumjaithai candidate ( previously with Future Forward) posted that a political leader should brace himself for news about media shares

Now a video clip from the ITV meeting emerges where it is said that the company is no longer in operation.

Yet in the complaint filed to the EC it is claimed the company is still in operation, this formed the base for the complaint.

Could the Bhumjaithai candidate be seeking revenge for having to change party or could he be just one part in a plot to ban Pita?

The crux of the case against Pita holding media shares is down to the 2020-2021  report to DBD report to DBD which changed the business type to TV media. Previous 2018-2019 financial report submitted to DBD showed iTV as a holding company. 'However in the latest report to DBD in 2023 just 4 days before the election, the report stated that iTV had carried out businesses of 'campaign media and investments". Pita is claiming that there is a conspiracy behind the changes in the reports to DBD to thwart his political ambition. He noticed such suspicious happenings surrounding the iTV shares and he asked his heirs to take over the shares entitled to him. This is serious evidence against him and it's a 50/50 chance that he will lend himself imprisoned or banned from politics. The only saving grace is that his shares are very little and in no way possible for him to play a role in influence PBS. There was precedent in a similar case whereby the Supreme Court ordered the EC to reinstate K Charnchai for holding 200 shares in AIS. The Court ruled that the value of shares were pittance and cant influence AIS.

Who controls iTV? Still Thaksin? Could have PTP lay this egg for him?

I recommend to listen a bit to their foreign minister.....She has a few gaps in her education...like told that Putin must turn 360 degree and recently she traveled to a 100.000km away country....And every week there is something like that.

Those gaffs are news to me so not many laughing. You should check her education. She's eminently qualified to be a foreign minister, and is also an effective one as well. Maybe your qualifications and experience are better? Mine ain't. But this is getting way too off topic for my taste.

The naivety is strong in this one.

Even one share in a media company is illegal.

Managing or controlling just one share means a court case.

Not true - Democrat politician had 6 shares in a media company and the EC decided that he didn't have enough influence with only 6 and allowed him to remain as an MP. One rule for one & .....................  You know the rest. ????

The newly elected government. Why do you think the EC, Senators and various other old dinosaurs are so worried. They will be investigated as to where all their money came from. Time for payback, and the old guard is scared to death and clinging on by their fingernails.

That's  dreaming of future to come/or never will come.

You did not mention in your post the future but present.

For this what you're dreaming of is a lot of laws to be implemented same as a new constitution. Long  and winding road. Many obstacles, many soldiers.
