Former prime minister Thaksin Shinawatra has made a renewed plea to the attorney-general to reconsider a lèse majesté charge against him. Thaksin, who has recently been paroled, is seeking to avoid the indictment set for June 18. This follows an initial failure to attend a court hearing on May 29, citing a COVID-19 infection.

 

Attorney-General Amnat Chotcharoenrak decided to charge Thaksin based on an interview he gave to a South Korean media outlet in 2015, which allegedly contained remarks insulting to the monarchy. Thaksin is also facing accusations related to the Computer Crime Act alongside the lèse majesté charge.

 

In this latest petition, Thaksin argues that the original investigation was compromised. He claims that the committee, led by former Attorney-General Trakul Winitchaipark, acted under the influence of the military junta that was in power at the time.

 

During a recent visit to Pathum Thani to attend an ordination ceremony, Thaksin told reporters that he was unfairly accused by an investigation tainted by bias. Describing the charge as the "fruit of a toxic tree," he emphasised that the officers involved were not independent.

 

In response, former Attorney-General Trakul Winitchaipark took to Facebook to deny Thaksin's allegations. "I would like to confirm, with the honour of a man, that no one ever coerced or persuaded me to perform my duty wrongfully," he stated, upholding the integrity of his actions as per Section 20 of the Criminal Procedural Code, which applies to cases occurring outside the country.

 

This unfolding situation continues to garner significant attention as Thaksin's request demands deliberation from the current attorney-general. The coming weeks will reveal how these legal challenges will progress and their broader implications for Thailand's political landscape.

And the Supreme Court in Thailand have already decided in 2019, that any crime committed outside of Thailand isn't valid in Thailand.

Just treat him like any section 112 suspect. Jail with no right to bail. No double standards....lol.

I believe it's time we farrangs stop referring to any of these 'girls'. I find it a bit sickening and sad. Thailand has more than this to it's credit. So many of them are there and don't wish to be there, due to reasons beyond their control. There but by the Grace of God, goes you and I!

Well, then you should sue Thaksin for defamation.

One wonders if all alleged crimes committed outside of the country are held against you in Thailand? Possessing and dealing in drugs and a prison sentence served, for example?

Sounds like Thaksin is trying to find ways to delay the court again. Saying he had Covid only delayed it a short time. Am sure he needs more time to get the right amount counted in the envelopes he is planning to fill.

Eligibility for Thaksin's parole was triggered by a 2023 Royal Pardon. But the AG appears in effect with his 2024 LM charge to place limits on how and when the Pardon is relevant? That would seem to be contrary in a constitutional monarchy form of government. 

I have heard rumors of a general amnesty for minor offences coming soon .. probably right after his conviction ...

No, if a person is convicted of a crime in a foreign country, that doesn't disqualify him from becoming an MP or joining the Cabinet. But crimes commited overseas can be prosecuted in Thailand. There was the famous case of Joe Gordon, an american citizen who had a blog that translated part of "The King Never Smiles" into Thai. When he visited Thailand, he was arrested and convicted of lese majesty even though that's obviously not a crime in America.
