My chum who was taken by DWP is now in his last days on earth, I see him every week for a chat, last week, we got on to DWP looking at bank accounts, his wife brought up the money she paid back, she said, 250,000bht... Her words, way back when my chum said he paid back 5000 quid, yeh, back then it was around 25,000 bht, so, going to call me a liar again........🤨 1 1

Sure I don't know, I only know about my friend and the bloke he knew. But from all the latest stuff from the gov, who are stating fraud money lose figures, they know exactly what is going on, hence the looking into bank accounts thingy. People spout about, oh you can't look into folks private bank accounts, but, if stolen Gov money is there, being moved around to commit fraud, then I do not see any reason why the be prevented from doing it. After all, those who are fiddle the pension, mostly knew/know what they were/are doing......😎 3 1 2

The claimant deliberately misrepresents their circumstances or fails to disclose material facts in order to obtain benefit to which they are not entitled. DWP only classifies an overpayment as fraud where there is either admission by the claimant after “caution”, upon conviction in court or acceptance of an Administrative Penalty" According to appendix 1 DWP says no fraud on ANY overpayment of benefit unless you admit it (after caution), or a court finds you guilty. Interesting find as it directly contradicts statements posted by @transam And backs up my opinion to always deny and admit nothing. 3 1

From what I can see the State Pension is classed as a benefit and presumably comes under this Regulation 16. Prescribed circumstances – Regulation 16 2001 Benefit can be suspended in the following prescribed circumstances: where there is a doubt as to whether a person receiving JSA is available for or actively seeking employment where there is doubt whether the conditions for entitlement to benefit are (or were) fulfilled if a question arises over whether a decision to award benefit should be revised or superseded if an issue arises over whether any amount paid or payable in connection with a claim is recoverable if a customer is not residing at the last address notified to you where an appeal is pending against a decision of an FtT, UT or Court where an appeal is pending in a different case (the “lead case”) and the result of the appeal might affect the case you are considering (the “lookalike case”) 2002 If serious doubts arise you can suspend the award immediately, before notifying the customer, but the customer must be notified as soon as possible afterwards that benefit has been suspended https://www.gov.uk/government/publications/suspension-and-termination-of-benefits-staff-guide/suspension-and-termination-guide#circumstances-when-payment-can-be-suspended 1
