Trump administration admits man was deported to El Salvador mega prison due to 'error'

The only "error" was that a judge knew he was a gangbanger but let him stay anyway.  His homies back in da hood might poop a cap in his crown.

Mr. Abrego Garcia had “withholding from removal” status, which means he was the subject of a deportation order but was allowed to stay in the United States because of the likelihood that he could be harmed if he returned to El Salvador.

According to Abrego-Garcia's attorneys, in 2019, a confidential informant "had advised that Abrego Garcia was an active member" of the gang MS-13. He later filed an I-589 application for asylum and although Abrego-Garcia was found removable, an immigration judge "granted him withholding of removal to El Salvador."

Let him come back to the USA and be detained indefinitely as he was denied bond. This is a case of play stupid games and win stupid prizes. El Salvador is his home and he claimed asylum because he is a gang member afraid of gang retaliation. Hey if he prefers to spend  his time in GITMO I won't object.

Obviously he has no place to go and no money to fund a ticket. If that is the case it doesn't matter where he is detained, it doesn't  give him the right to walk around freely.

Kilmar Armando Abrego Garcia had legal protection from being deported to his home country of El Salvador, from which his lawyers say he fled aged 16.

The Trump administration has admitted to deporting a Maryland resident to a Salvadoran mega-prison due to an "administrative error" despite a court order barring him from being sent to the country.

While it appeared to acknowledge the mistake, the government then argued it could not return him to the US, where court records filed by his lawyers state he has lived since 2011, and has a family.

What makes this case particularly damning is that El Salvador was the one country he couldn't legally be deported to.

The law is an ass.

Doesn't matter if the judge was a raving, lefty, card-carrying Democrat, the law said the thug shouldn't have been sent home.

That sounds like a most equable solution to me.

Torturing people is a crime.

If the government of El Salvador is torturing people in the supermax there, they're criminals.

If they're criminals, they're colluding with another criminal convicted of 34 felonies.

What a coincidence. 🥹

In a decision handed down without any dissent, the Supreme Court of the United States (SCOTUS) is now ordering President Donald Trump's administration to immediately "facilitate" the return of a man it admitted was mistakenly included on a deportation flight to El Salvador.

SCOTUS is ordering that Maryland man Kilmar Abrego Garcia be brought back to the United States.

"To this day, the Government has cited no basis in law for Abrego Garcia's warrantless arrest, his removal to El Salvador, or his confinement in a Salvadoran prison," Sotomayor wrote. "Nor could it."

Abrego Garcia was specifically protected by a 2019 court order preventing him from being sent to El Salvador, as he faced significant risk of persecution by the regime. The administration, however, argued that Abrego Garcia was a member of the MS-13 gang, though it has yet to provide any evidence of its claim.

Supreme Court unanimously rules against Trump in case of wrongfully deported man

We can only hope trump gets down on his hands and knees and grovels to the El Salvador President that some random gangbanger is returned. Whatever the SCOTUS says he is a citizen of El Salvador, residing in El Salvador and subject to their jurisdiction now. No way is he returned now. This pretty much guarantees that. If he stays there this story is dead in a week.

Some people see his behavior not as stupid, but as rebellious or refreshingly blunt.

Blunt is a synonym for dull, not sharp.

Oh so refreshing to use a knife that's not very sharp?

No.  That's dangerous. 😀

Yeah, the Trump administration has no contractual agreement with the El Salvador President involving money.

El Salvador just let a Trump administration official into their prison randomly off the street to do a promotional political piece for the Trump administration.

What a coincidence.

Sure, Jan.

Is that what you expect the American people to believe?!?!? 😭

One of these orange men is smart.

Can you guess which one? 😃

Trump’s tariffs will inevitably hurt parts of the Chinese economy, Beijing appears to have far more cards to play this time around. It has the tools to inflict meaningful damage on U.S. interests – and perhaps more importantly, Trump’s all-out tariff war is providing China with a rare and unprecedented strategic opportunity.

Maybe Trump can deport Banksy to El Salvador too for being a woman.

Or maybe MS-13. 😃

Trump DoJ unable to tell court where man wrongly deported to El Salvador is

Thing is, there's no jury in America that won't find Trump's explanation that he "knows nothing" entirely believable. 😃

I'm really concerned that he's going to order this guy to be murdered if he isn't dead already.

Imagine he comes back and tells stories about that El Salvador prison and that he was sent there without cause and without due process.

Fascism is NOT too strong a word folks.

Any officials involved with this illegal deportation and imprisonment should remain in jail until he's returned to his family in the US.

You missed one important point there. As a judge has now pointed out in court, the confidential informant's information was not credible. So there's no real evidentiary basis for believing Abrego Garcia was a member of a gang.

Quote

Judge Xinis has noted that “the ‘evidence’ against Abrego Garcia consisted of nothing more than his Chicago Bulls hat and hoodie” as well as “a vague, uncorroborated allegation from a confidential informant claiming he belonged to MS-13’s ‘Western’ clique in New York — a place he has never lived.”
