I am very unsecure when my friend ask me for advice concerning what happens

if his wife dies before he does.

 

Background is;

They are a married couple (he is swedish she is thai)

There is a daughter outside this marriage (adult)

this daughter have a son 7 years old living by the falang/thai lady.

The daughter is not.

Falang and thai wife have a testament saying that inheritence will not

be actual until they both are dead...

 

So if by all means this not happen, but if wife (thai) dies before he does, what happens?

and can a 7 year old boy owns a house/property. And if possible can hos mother who is

not even the guardian take possion of this house while falang still lives in it??

 

My falang-friend just want to be secured if something happens to his wife, so he cant be

kicked out by the remaining thai family.

Please, if you guys can assist in this that would be great.

I must just add in case it is not understood. The daughter adult outside this marriage is from a former marriage with falangs wife. So there is no blood from him, if that even matters??

Usufruct. Stamped on the property title deeds. He has full legal right of the property until he dies. Around 100 baht at the local land office.

Daughter and husband inherit 50/50 unless will stating different.

If house purchased within marriage period, husband already owns 50% so on wife's death his share 75%, daughters share 25%.

 

Grandson will inherit nothing without a will.

No problem with a minor owning land, it will have an adult legal guardian until they are an adult so it cannot be sold or borrowed against without court approval. 

 

He is the grandson, he will not automatically inherit anything. 

 

The foreigner and Thai land owner (presumably his wife) go to the local land office and get a usufruct in his name on the title deeds which then lasts until he passes away. It should cost around 100 baht. A few offices might not like doing it. YMMV. Get a will leaving the land to him. If he inherits if, he then has 12 months to transfer the land to a Thai, if he fails to do so the land office can sell the land and keep 5% of the selling price. His usufruct on the title deeds means that he has legal rights to and control of the land regardless of who owns it until he passes.
