Federal appeals court rules USA tariffs are illegal

Featured Replies

"A federal appeals court ruled Friday that most of President Donald Trump’s global tariffs are illegal, striking a massive blow to the core of his aggressive trade policy.

The U.S. Court of Appeals for the Federal Circuit ruled that the law Trump invoked when he granted his most expansive tariffs does not actually grant him the power to impose those levies.

Trump is all but certain to appeal the ruling to the Supreme Court. The appellate court paused its ruling from taking effect until Oct. 14, in order to give the Trump administration time to ask the Supreme Court to take up the case."

How does it feel knowing you guys have no power anymore? Only yourselves to blame

I’m surprised the ruling was 7-4.

In President Trump's Truth Social posts * as mentioned in the cnbc link above and submissions to the Appeals Court that just published its decision, they have said (in my words):

You can't rule these tariffs as illegal. There is no way to unwind or refund them .It would be like trying to put toothpaste back into the tube.

* "If these Tariffs ever went away, it would be a total disaster for the Country," Trump wrote in a Truth Social post. "If allowed to stand, this Decision would literally destroy the United States of America."

Also, from the CNBC link above:

Trump attacked the appeals court as "Highly Partisan" and asserted that the Supreme Court will rule in his favor.

-- Because (to him) the Supreme Court is highly partisan in the right direction.

Hope it holds up,I for one don’t like his trump tax imposed on me.It would hopefully stabilize our economy and get the interest rates lowered for sound valid reasons.

He cannot even get that bit correct. The 7-4 vote in the Federal Circuit's ruling against Trump's tariffs on August 29, 2025, was not strictly along party lines. The majority consisted of six Democratic appointees (e.g., Timothy Dyk, Jimmie Reyna) and one Republican appointee (e.g., Alan Lourie), while the dissent included two Democratic appointees (Richard Taranto, Raymond Chen) and two Republican appointees (Kimberly Moore, Sharon Prost). This cross-ideological split indicates the decision was driven more by legal interpretations (e.g., the major questions doctrine and IEEPA's limits) than partisan allegiance, though Trump labeled it "highly partisan."

Trump seemed to forget Madison was explicit about Mad Kings imposing tariffs on citizens — which is why he placed that power squarely in Congress under Article I, Section 8 and the Origination Clause.

Perhaps the Boston Tea Party peaked the Founders’ resolve — and for him, Trump’s latest 50% tariffed coffee would have ended up in the harbor.

On one hand, crashing the economy may be the best way to get these yahoos finally out of power.

On the other hand, it's still crashing the economy.
