Thai worker's rights

Featured Replies

My 25 year old step daughter has worked in a financial institution for over 2 years, inputting data into iMac computer, and general office work. Gets just less than Bht 15000 per month.

A new boss has started this week as the older one reached 60 and retired. He insists that all staff MUST have their own iPhone or they cannot work there any longer.

Is this legal? Blackmailing the workers. It would be totally unacceptable in civilised countries.

There doesn't seem to be a specific rule regarding having to provide your own equipment to undertake a role.

However, I would think this rule might cover this instance, as it doesn't seem fair or reasonable.

Section 14/1 A contract of employment between an Employer and an employee, work rule, regulation or order of an Employer result in the Employer being in exploitation of the Employee, the Court shall have a power to order such contract of employment, work rule, regulation or order being enforceable only to the extent as it is fair and reasonable.

Labour laws in Thailand often favour the employee, so I'd suggest she contact her local Labour Office to discuss this.

If she is worried about being fired for making a fuss, under Thai law she be owed 90 days salary Severance Pay for unfair dismissal.

She’s making fuss up so u old man will buy her new iPhone 17 so sad… what a chaos have a NICE day and do not forget to smile!!!! Sorry if I offended u

but don’t be a cheap skate and buy 5000bajt vivo or something…

make her SMILE with you!!! Chhers

Uncorroborated hearsay until you post a copy of the bosses instructions.

Do the company pay for their Iphones?

I have just retired an iPhone 13, gone back to Android. Still in tip top condition.....make an offer?

NO! They must buy their own, and use it for Company business.

I would have thought that the new boss would have said 'No private phones in the office during working hours''

So you don't believe me. I know what the boss has told her.

I don't know Thai law, but I can tell you, working here 20+ years at an electronics factory, that all the staff (above operator level) are expected to have their own phone and laptop to do the job. No company phones, even for the senior director staff.

Oh lodge a complaint!!

This is Thailand. Depending on one's connections, anything can go from illegal to legal and the other way round.

Isn't that so wrong. The Company should ban all personal phones during working hours to prevent interruptions of the work.

I did read somewhere that even the Cops have to buy their own guns.....true?

Nonsense, Thailand has a good Labour law and a Labour office who will help you enforce it.

The only problem is that a lot of people don't know the law.

But when the Boss says  ''gét your own Phone or you can finish working here', even with 90 days pay, if she is lucky, jobs are not easy to find, and mouths need feeding, the Law means nothing.

I reckon she likely already has a phone, just not an apple one which the new boss is insisting on.

Not if she is lucky, she will get the pay if she involves the Labour office. The boss can end up in jail when not paying and get a bigger fine.

If you have qualifications, you can find a job. I got a new job here when 56 years old.

I've worked for 6 different companies in Thailand over the past 15 years or so, and laptops were always provided by the employer for all staff members.
