Neither is correct, it is an Occupied Territory:

 

Effective control: The presence and authority of the foreign force must be established and capable of being exercised, which can include imposing its own laws and administration.

 

Unconsented presence: The foreign force's presence is without the consent of the sovereign power of that territory.

 

Inability of local authority: The original sovereign power is unable to exercise its authority over the territory due to the occupation.

 

International law applies: International humanitarian law, such as the Geneva Conventions and The Hague Regulations, applies to occupied territories, establishing rules for the conduct of the occupying power. 

 

As an aside, Israel does all the above , but fails to adher to International Laws, and the Geneva Conventions.

4 out of 10 families struggle to acquire enough food. In Gaza, more than 830,000 Palestinians need assistance in the form of food or nutritional supplements.

According to UNRWA, the large cuts in funding from the US will cause the UN to have to reduce food support. Most of those who will be affected are already living below the poverty line.

98 per cent of ground water is undrinkable
98 per cent of the water in Gaza is contaminated and undrinkable. Gaza has beautiful beaches, but every day, 90 million litres of unfiltered sewage is pumped out along the shoreline.

2-4 hours of electricity
The Gazan population cannot count on more than 2-4 hours of continuous electrical power a day. Every day, Gaza experiences up to 22 hours of power outage.

35 per cent of arable land is unavailable
35 per cent of the land eligible for farming is unavailable and fishermen are blocked from 85 per cent of the waters on the coast of Gaza due to Israeli security zones. 

7 per cent of children suffer from stunted growth
Poverty and a lack of food has led to 7 per cent of children suffering from stunted growth due to long-term malnutrition. Sixty per cent of the children are anaemic.

45 per cent are refused medical treatment outside Gaza
Those in need of specialised medical treatment must apply for permission from the Israeli government to leave Gaza. Many applications are declined, or at best delayed, and many risk dying while they wait.

What differentiates an "open air prison" from a prison?  From what I saw, not too many Gazans were living in the open air. They are housed, either in apartment blocks or single family dwellings. Some rather well housed in mansions. They shop in malls or local markets, drive cars, have restaurants, go to the beach. None of these situations screams "prison" to me. 


If anything, they live in a prison created by and built by Hamas.  The theft of aid, use of donated construction materials for terror tunnels, coercing of UNRWA into a Hamas accomplice, etc. Perhaps the worst of all is the total infiltration of the school system and curriculum by Hamas and other radicals. Children are fed hatred with their mothers' milk.

The ultimate sense of superiority is the refusal of Hamas and other Arab groups to recognize the right of Israel to exist as the homeland of the world's Jews.  If the Arabs had accepted the two-state solution in 1947 and recognized Israel, the history of the Middle East would have been very different and thousands upon thousands of lives would have saved.  How many Palestinians and other Arabs have died trying to drive the Jews into the sea?

Until one day your phone rings. Your 14-year-old son was shot by IDF soldiers, while  playing football with friends.

 

Your world collapses. Grief is unbearable. This time you want to fight. You want justice.

 

So, you go and file a complaint with the Israeli authorities.

 

Same as countless of other Palestinians who filed complaints between 2017 and 2021, where Thousands of Palestinians were shot and more than 70.000 heavily injured by the IDF or settlers.

 

But from all those complaints only 1260 were accepted by the Israeli military law enforcement system.

 

But you are lucky, yours is among those 1260.

 

Most of those complaints were dismissed after a "preliminary examination," and only 248 investigations were opened.

 

You are lucky again; your complaint is among those 248.

 

Again, the vast majority of them were closed without prosecution.

 

You are lucky again, yours is one of the 11 investigations which led to indictments against soldiers.

 

The IDF soldier who murdered your son had clearly acted contrary to the instructions and approval of his commanders. There was no reason to kill your son. He had done nothing wrong.

 

And Jackpot! He gets prosecuted.

 

At least maybe your way of living, your commitment to peace and against any kind of violence and hope for coexistence in harmony with the Israelis was the right thing to do.

 

It couldn't protect him from being killed but at least justice has prevailed.

 

That's what you think.

Thirty days of community service.

 

This is what your boy’s life is worth.

 

Thirty goddamned days.

Okay, so no Israeli soldiers in Gaza in 2020, but some in the West Bank. There are less than 170K active personnel TOTAL in the IDF, and there are about three-million Palestinians in the West Bank, but we're to believe that these three-million Palestinians are all being harassed almost daily and sometimes pushed around by the IDF.

 

If half the IDF are in the West Bank full time, each one would have got door to door and harass 35 Palestinians a day for this to be true.

Imagine it is 2020 and you are living in Gaza or in the West Bank. You're a Palestinian.

 

You are harassed by Israeli soldiers almost daily, stopping you for no reason, asking you funny questions, sometimes even pushing you around."

 

Okay, so no Israeli soldiers in Gaza in 2020, but some in the West Bank. There are less than 170K active personnel TOTAL in the IDF, and there are about three-million Palestinians in the West Bank, but we're to believe that these three-million Palestinians are all being harassed almost daily and sometimes pushed around by the IDF.

 

If half the IDF are in the West Bank full time, each one would have got door to door and harass 35 Palestinians a day for this to be true.

OK, maybe too many words for you so here is the summary:

 

Between 2017 and 2021, Thousands of Palestinians were shot and more than 70.000 heavily injured by the IDF or settlers on Palestinian soil.

 

Many Palestinians filed complaints.

 

But from all those complaints only 1260 were accepted by the Israeli military law enforcement system.

 

Most of those complaints were dismissed after a "preliminary examination," and only 248 investigations were opened.

 

Again, the vast majority of them were closed without prosecution.

 

11 investigations led to indictments against soldiers.

 

A few soldiers got prosecuted and received sentences

 

Less than 1% of the IDF soldiers who had murdered innocent Palestinians, many of them children, were prosecuted. They got 1 to 2 months of community service.
