This has been discussed several times before. The answer is always the same: you have to distinguish between the use of the words "Palestine" and "Palestinian" for a geographic area as opposed to a political entity such as a nation, kingdom, country, etc.

People (pagans, Jews, Arabs, Muslims, Arabs, Europeans, Africans) have lived for several millennia in the geographic area called Palestine. Those people were Palestinians in the same sense as indigenous people were North Americans. The designation depended on where they lived, not their ethnicity or nationality.

However, there was no State of Palestine until 1988, hence prior to that there were no Palestinians in terms of nationality, citizenship or ethnic group.

Exactly right. The Arabs of Palestine are and were generic Levantine Arabs. In terms of language, culture and religion, they were no different in any important sense from the Arabs of Syria or Jordan.

Its already been established by the International court that genocide isn't happening in Gaza.

There was ruling on January 26 th 2024 and Israel didn't get found to be guilty , icj stated that Israel can continue with the war in Gaza

Are two different statements

here are currently

two active cases at the International Court of Justice (ICJ) related to Israel and the Occupied Palestinian Territory: the case initiated by South Africa alleging genocide and the advisory opinion requested by the UN General Assembly on the legal consequences of Israel's policies and practices. 

1. Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel) 

This contentious case, initiated by South Africa in December 2023, alleges that Israel is violating the 1948 Genocide Convention in its military campaign in Gaza. 

  • Status: The case is ongoing, and a final ruling on the merits of the genocide allegation could take years.

  • Provisional Measures: In interim rulings in 2024, the ICJ ordered Israel to take all measures within its power to prevent acts of genocide against Palestinians in Gaza, enable the provision of urgently needed humanitarian aid, and prevent the destruction of evidence.

  • Compliance and Reactions: Israel has submitted reports to the court on its compliance with the provisional measures, but UN officials and human rights organizations argue it has largely failed to do so. Israel "categorically rejects" the case, describing it as politically motivated and arguing its actions are in self-defense against Hamas.

  • Intervention: Several countries, including Belgium, Ireland, Spain, and Mexico, have filed declarations of intervention, a process allowing them to formally join the case. 

2. Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem (Advisory Opinion) 

This is a separate, non-binding advisory opinion requested by the UN General Assembly (UNGA) in December 2022 concerning the legal consequences of Israel's prolonged occupation and its impact on the Palestinian people's right to self-determination. 

  • Advisory Opinion Issued: The ICJ delivered its advisory opinion on October 22, 2025. The Court concluded that Israel's occupation, settlements, and actions impeding the UN's work are illegal under international law and violate the Palestinian right to self-determination.

  • Key Findings: The opinion stated that Israel has an obligation to end its unlawful presence in the territory and facilitate the unhindered operations of UN agencies, including UNRWA, and other international organizations.

  • Consequences: The opinion is not legally binding in the same way as a judgment in a contentious case, but it carries significant legal and moral weight and will be transmitted to the UNGA for consideration and potential action. The UNGA subsequently adopted a resolution calling for the end to Israel's "unlawful presence" within one year. Israel has formally rejected the opinion. 


Note: The International Court of Justice (ICJ) rules on disputes between states, while the separate International Criminal Court (ICC) can prosecute individuals for war crimes or crimes against humanity. The ICC is also pursuing an investigation and has issued arrest warrants for Israeli and Hamas leaders. 

The International Court of Justice (ICJ) has issued several key rulings regarding the Israel-Hamas conflict, notably in

October 2025, affirming Israel's obligations as an Occupying Power, finding it failing to ensure basic needs in Gaza, and ordering unimpeded humanitarian aid access, rejecting security claims as justification for obstructing relief. Earlier, in January 2024, the ICJ ordered Israel to take measures to prevent acts of genocide and allow aid, while in a separate July 2024 advisory opinion, it declared Israel's occupation, settlements, and resource exploitation illegal under international law. 

Key Rulings & Findings:

  • October 2025 Advisory Opinion:

    • Israel is violating international law by not ensuring essential supplies and facilitating humanitarian relief in Gaza.

    • Security claims don't justify obstructing humanitarian aid or suspending operations.

    • Israel must actively support UN entities like UNRWA, which is crucial for Gaza's population.

    • Israel must facilitate regular, fair distribution of aid, using all means to ensure it reaches civilians.

  • January 2024 Provisional Measures (Genocide Case):

    • Ordered Israel to halt its military offensive and any genocidal acts in Rafah and elsewhere in Gaza.

    • Required Israel to prevent destruction of Palestinian life and allow aid access.

  • July 2024 Advisory Opinion (Occupation):

    • Israel's occupation and settlements in Palestinian territories are illegal.

    • Israel must pay reparations for damages caused by the occupation.

    • Israel's policies violate the Convention on the Elimination of Racial Discrimination (CERD). 

Context:
These rulings stem from cases brought by South Africa (genocide case) and requests for advisory opinions from the UN General Assembly. While ICJ rulings aren't always binding, they carry significant international legal weight, though implementation remains a challenge.
