hi there wonder if anyone can help, i am an LTA (UK) registered tennis coach and i want to set up a tennis coaching business in thailand, i have read about setting up a limited company but feel that this is not the way to go as i will be the only employee and was wondering what the procedure was for getting an individual work permit and whether this is possible, thanks in advance for your replies

Unfortunately, there's no way around this. Either you have to work for a company that can apply for a work permit on your behalf, or else you have to set up a company with minimum 2 million baht registered capital, plus possible minimum requirement of 4 Thai employees, before that company can apply for a work permit.

Sadly true and rules out a whole section of people who make money telecommuting or working online.. Personally I think they are missing out on some serious taxation contributions by not having a class available.

I believe there are a few legal ways to get around this but hopefully some1 will correct me as I have only heard people speak of this.

4 Thai employees

1 will also be part owner (silent partner)

2 could be your driver/delivery dude/motorcycle guy-this guy can be your run around for 6100b a month (minimum salary)

3 could be your cleaner. As your house will be your office and again this person will be on minimal wage of 6100b a month

4 could be a friend that helps with translating, accounts and can be paid as they work (or give them 2000 for nothin u keep rest ha ha)

I believe you do not need any Thai employees to get a work permit. That requirement is for an annual extension of stay.

In my experince you do need an organisional chart to support an initial WP. This chart seems to be able to imply a work force, but does not require any specific details of Thai staff.

I think both you and Maestro are right. I don't remember ever being asked for details of my staff either when applying for a work permit. And Maestro says this is for an annual extension of stay - now it kind of makes sense.

This is very true. One of my ex colleagues wanted to set up a business working from home via the internet but ran into the brick walls of not being able to obtain a W/P so seeing as he's married to a local with two children (his own) and didn't want to leave having a home here he's working illegally from home with no W/P and the Thai government are missing out on the profit from taxing him on a 200k plus baht income per month.

Basically it's not as if he's denying a local a job because he's a one man operation and the people he does work for are internationally located, not Thai.

And without that are you getting multiple non B's in any loca SEAl consul ??

Most people either have a multiple entry visa from their own country or arrive with a 90 day visa. They get the wp then go to Penang and get a one year multi entry visa.

If you are starting up a company, its been impossible since Oct 1st 2006 to get a extension of stay based on business as you need an annual audit. If you just start your company this year, the earliest you could qualify is 2008 so no need for 4 Thai employees this year as you are not going to qualify based on not meeting the criteria of having a annual audit.

Most companies that set up in November and December, won't qualify till 2009 as the audit must show income higher than the foreign salaries. In Pattaya its net profits must be higher than the salaries.
