Motorbike Transfer Details

A bit of a complicated situation : I purchased a Honda Dream 125cc (2002 model) earlier this year, but as I had a non-imm O Visa I wasn't sure about the rules as to whether I could actually own a bike in my name or not, and never transferred it over...Meanwhile, I drove it around (yes, foolish I know!) and retained ALL the tax and registration papers, Green Book etc...luckily I never got into an accident or other legal motor problem, but I know it was ill-advised.

Now, "fast-forward" to the present: I see that the sticker says year 2550 (this year?) and I think the expiry month is past already??

The good news is that I WILL soon have a valid work permit and correct visa, so I can now put it into my name, open a bank account etc..

MUST the owner (the original, legal one) be present and with me to transfer ownership? If I cannot locate him, or he left Phuket, what then?

Will there be a "penalty" for having an expired registration sticker, even if only a few months out?? How much will it cost for all of this, and which Office in Phuket Town do I need to do this?

Sorry for all the questions, but I want to be on the "right side" of the Law ASAP!

No problem for you to drive the bike, anyone can drive a the bike. You don't even need to be the owner to renew tax & insurance. Just go to any insurance office with the green book and get insurance (about 330 baht), if bike over 5 years old the need MOT at any garage that does that (about 80 baht), then Phuket Vehicle Licence Centre for tax (100 baht) and just a couple of baht fine if overdue.

You can only trransfer to your name if the present owner signed the appropriate transfer form, and proper mandate form with 2 witnesses if owner not accompany you to the licence office for transfer. If you don't have these signed forms and the owner has left town there is not much you can do.... :o .

Just keep on paying tax & insurance each year, really does not matter if the bike is not in your name. Problem occurs when you want to sell the bike on to someone else....

If the owner on paper has left the island and you havent changed name you have hust halved or more the value of the bike..

The original owner must sign some forms, and provide passport copies showing thier current visa stamps and entry card if farang, Thai ID if Thai..

Money can fix the lack of these papers quite often tho.

Riding about not in your name is not a problem as said and also you can renew tax and insurance even if not the owner.

Thank you both for your sage advice. I found out the Owner IS still on Phuket, so he will have to accompany me to Phuket Town to transfer the name. This is clear to me...hopefully it's a relatively quick procedure??

However, can I assume ownership from him WITH JUST a non-imm O visa in my Passport, or is it "better" to wait until I have a "full" B visa and work permit?? It should be a matter of just another week or two I think and I will have those....

Or does it matter at all??

Lastly, according to you both I can simply ride to ANY Insurance Agent and get the appropriate renewal sticker and insurance? Will I need to bring my Passport to said Agent?

And, since you are much more adept at this than I, WHERE do you recommend I go (Chalong, Kata, even Patong)--just need a specific name/address.

Best that the present owner accompanies you, but not necessary if you have him sign an additional mandate form witnessed by 2 people.

You MUST obtain a 'residency' paper from Immigration office. All you need is a current non-imm visa. Don't need WP. Without this paper you CANNOT transfer a vehicle into your name.

No need for passport or ID when applying for insurance & tax. Just need the green reg book.

There used to be an insurance desk in the lobby of the Vehice Licensing office. Else just look for any office that deals with insurance. Many many on road from Kata to Phuket Town. I don't have specific street address. One on Kata main rd just before Wat Karon, about opposite the 7-11, maybe nearer Big One.Same side Big One.

Yeah can do insurance at same time as transfer (in fact I think they insist on it if not in current stamps)..

If not theres a guy in Patong near the temple who can do it.. In fact he will also do all the ownership transfer for you if your lazy.. Obviously he charges a few 100 premium but if your not keen on going to the Phuket town transport office and dealing with everything in Thai then it is probably worth it.

I assume theres guys like this all over the island, but this is the only one I know of.

Thanks for the tips Kata---but rather than go to Immigration twice, better I just wait until I go there next week for changing my Non-O to Non-B (work) Visa anyway, and get the "residency paper" at the same time..

As for insurance/tax will check into the Kata Agent you suggested--I am not that comfortable riding around Phuket Town yet. I always seem to take wrong turn and end up totally lost!
