Hi there

I was wondering if I could have some general advise with respect to applying for a Visa to the UK.

I met my wife in UK 2 years ago, she returned to Thailand in July 2007. We got married in November 2007.

My wife entered the UK illegally and returned to Thailand under her own devices i.e. not forcefully removed.

We applied for a tourist visa in October 2007 but were refused given her immigration record.

We are now applying for a marriage visa, we are always going to up against her immigration to the UK record. I have sought legal advise in the UK and in Thailand. The UK advice was very positive but I did not engage them to do the application because of the difficulty of her obtaining all the relevant Thai documentation from the UK. The Thai advice is mixed but they are better in terms of obtaining the Thai documentation.

Any advice would be greatly appreciated? The plus points in our favour are that I have a good job and a house that is paid for together with some savings but there are numerous things against us.

Feel a bit helpless at the moment.

Just because your wife has an adverse immigration history does not automatically mean that she cannot now get a visa for the U.K.

Essentially, the success of such an application will depend upon how your covering letter is written. It should refer to the previous history and address how this is not relevant, with due reference to the law and current policy.
